Facial Recognition Technology: How It Works, Who Uses It, and Why It Matters
Facial recognition technology has moved from science fiction into everyday reality with remarkable speed. You may unlock your phone with your face, tag friends in photos automatically, or pass through airport security with a glance at a camera. At the same time, law enforcement agencies are scanning crowds for suspects, retailers are identifying shoplifters in real time, and authoritarian governments are building systems of mass identification.
This guide explains how facial recognition actually works, who is using it, where it fails, and why the debate over its use is one of the most important privacy conversations of our time.
How Facial Recognition Technically Works
Facial recognition is not a single technology but a pipeline of interconnected processes. Understanding each stage clarifies both its capabilities and its limitations.
Stage 1: Face Detection
Before a face can be recognized, it must first be detected within an image or video frame. Face detection algorithms identify regions of an image that contain faces, distinguishing them from backgrounds, objects, and other body parts.
Modern detection systems use deep learning models trained on millions of images. The most common approaches include:

A typical face embedding might contain 128 to 512 numbers. These numbers encode the distinctive features of the face: the distance between eyes, the shape of the jawline, the depth of eye sockets, the width of the nose, and hundreds of other measurements and relationships that are not individually meaningful but collectively form a unique identifier.
Crucially, the neural network learns these features during training rather than being explicitly programmed. The system discovers which facial characteristics are most useful for distinguishing one person from another.
Key technical detail: The face embedding is a one-way transformation. You cannot reconstruct a face image from its embedding alone, but you can compare two embeddings to determine whether they came from the same person.
Stage 4: Matching
The final stage compares the extracted face embedding against a database of stored embeddings. This comparison uses distance metrics — mathematical measures of how similar two embeddings are.

Accuracy Rates and the Bias Problem
Overall Accuracy
Under ideal conditions — well-lit, front-facing photographs taken in controlled environments — the best facial recognition systems achieve accuracy rates exceeding 99.5% on standard benchmarks like the NIST Face Recognition Vendor Test (FRVT).
However, real-world conditions are rarely ideal. Accuracy drops significantly with:
- Poor lighting or extreme angles
- Low-resolution images (security cameras, crowd footage)
- Partial face occlusion (masks, sunglasses, scarves)
- Aging (faces change over time)
- Identical twins
The Bias Research
In 2018, MIT researcher Joy Buolamwini and computer scientist Timnit Gebru published a groundbreaking study titled "Gender Shades" that exposed severe demographic bias in commercial facial recognition systems. Their findings showed:
- Error rates for darker-skinned women were up to 34.7% in some commercial systems, compared to error rates below 1% for lighter-skinned men
- IBM's system misidentified darker-skinned women 34.7% of the time
- Microsoft's system had an error rate of 20.8% for darker-skinned women

Why the bias exists:

Facial recognition has become a standard tool for many police departments. A 2021 survey by the Government Accountability Office found that 20 of 42 federal agencies that employ law enforcement used facial recognition technology.
Common law enforcement uses include:

Consumer facial recognition operates in a fundamentally different way from surveillance systems.
Apple's Face ID uses a dedicated infrared sensor to project over 30,000 invisible dots onto the user's face, creating a 3D depth map. This is processed entirely on the device — the faceprint never leaves the phone and is stored in the Secure Enclave, a dedicated hardware security module. Apple cannot access it, law enforcement cannot request it from Apple, and it is not used for any purpose other than device authentication.
This on-device, user-controlled model represents the privacy-respecting end of the facial recognition spectrum. It demonstrates that the technology itself is not inherently problematic — it is the context, scale, and governance of deployment that matters.
The Clearview AI Controversy
No discussion of facial recognition is complete without addressing Clearview AI, which brought the most extreme implications of the technology into public awareness.
Clearview AI built a facial recognition database by scraping billions of photos from social media platforms, news sites, and other public web sources — without the knowledge or consent of the individuals pictured. The company claims to have over 40 billion images in its database, covering a significant fraction of the world's population.
The service allows law enforcement clients to upload a photo of any person and receive matches from the database, along with links to where those images appeared online — effectively enabling the identification of nearly anyone from a single photograph.
The backlash was significant:
- Facebook, Google, Twitter, YouTube, and LinkedIn sent cease-and-desist letters demanding Clearview stop scraping their platforms
- Multiple countries, including Australia, France, Italy, Greece, and the UK, found Clearview in violation of privacy laws and imposed fines
- The ACLU filed a lawsuit under Illinois' Biometric Information Privacy Act (BIPA), resulting in a settlement that restricts Clearview's commercial use
- Canada's privacy commissioner called the company's practices a "mass surveillance" tool and ordered the deletion of Canadian images
Despite this opposition, Clearview AI continues to operate, primarily serving law enforcement agencies. The case illustrates a fundamental challenge: once facial recognition databases exist at scale, they are extremely difficult to dismantle.
City Bans and Moratoriums
Growing concern about facial recognition has led several US cities to ban or restrict government use of the technology.

International Approaches
European Union
The EU AI Act classifies real-time remote biometric identification in public spaces as a high-risk application with strict requirements:
- Real-time facial recognition by law enforcement is generally prohibited, with narrow exceptions for specific serious crimes
- Systems must meet accuracy requirements and undergo conformity assessments
- Transparency and human oversight requirements apply
GDPR already provides a foundation: facial recognition data is classified as biometric data, a special category requiring explicit consent or another specific legal basis.
China
China has taken the opposite approach, deploying facial recognition at massive scale as part of its surveillance infrastructure. Applications include:

- Clear legal frameworks that distinguish between consensual use (unlocking your phone) and non-consensual surveillance (scanning crowds)
- Meaningful consent requirements that give individuals genuine choice about whether their faces are enrolled in databases
- Oversight and accountability mechanisms that ensure the technology is used as intended and errors are corrected
- Prohibition of the most dangerous applications — mass surveillance, ethnic profiling, and social scoring — regardless of accuracy
The technology itself is neutral. A camera and an algorithm do not have intentions. But the systems we build with them reflect and amplify human choices about power, privacy, and control. Getting those choices right is one of the defining challenges of the current moment in technology governance.
