Overview

This case study returns to VitraMed — the health-tech startup founded by Mira's father, Vikram Chakravarti — and develops in full detail a dilemma introduced in Section 6.2.2: VitraMed has been asked to share de-identified patient data with a pharmaceutical company for drug development research. The dilemma is real, consequential, and — crucially — one where different ethical frameworks lead to different conclusions.

This case study walks through the dilemma using all five ethical frameworks from Chapter 6, demonstrating how each framework illuminates different dimensions of the problem and how a structured ethical reasoning process can navigate the inevitable disagreements.

The Situation

Background

VitraMed has grown from a small electronic health records (EHR) optimization tool serving fifty clinics to a platform managing health data for approximately 200,000 patients across the Midwest United States. Its database includes:

  • Clinical records: Diagnoses, treatment plans, lab results, imaging reports, medication histories
  • Demographic data: Age, sex, race/ethnicity, zip code, insurance status
  • Behavioral data: Appointment adherence, prescription refill patterns, patient-reported outcomes
  • Social determinants: Employment status, housing stability, food access (collected via optional patient questionnaires)

The data is stored in a HIPAA-compliant cloud infrastructure. VitraMed has a privacy officer, a data governance policy, and a patient consent framework that permits data use for "treatment, payment, healthcare operations, and research that advances medical knowledge."

The Proposal

Meridian Pharmaceuticals, a mid-sized drug company with a strong oncology pipeline, approaches VitraMed with a proposal. Meridian is developing a new drug for late-stage pancreatic cancer — a disease with a five-year survival rate of approximately 12%. Meridian's clinical trials have shown promising results, but the company needs real-world evidence data to support its FDA application and to identify which patient subgroups respond best to the drug.

Meridian offers VitraMed the following arrangement:

  1. VitraMed will provide a de-identified dataset covering all pancreatic cancer patients in its system (approximately 3,200 patients), including their complete clinical histories, demographic profiles, and treatment outcomes.
  2. Meridian will pay VitraMed $1.8 million for dataset preparation, transfer, and ongoing data support over three years.
  3. Meridian will use the data exclusively for the pancreatic cancer drug development program. Any additional uses would require a new agreement.
  4. The de-identification will follow HIPAA's Safe Harbor method: removing 18 categories of identifiers, including names, dates (generalized to year), zip codes (truncated to first three digits), and medical record numbers.
  5. Meridian agrees to a "no re-identification" clause — a contractual commitment not to attempt to link the data back to individual patients.

The Complicating Factors

Vikram Chakravarti sees the deal as a win for everyone: the data advances cancer research, VitraMed earns revenue that funds platform improvements, and patient privacy is protected by de-identification and contractual safeguards.

But several factors complicate this analysis:

Re-identification risk. VitraMed's pancreatic cancer patient population is relatively small (3,200 patients) and geographically concentrated in the Midwest. Research has shown that small, geographically clustered populations are more vulnerable to re-identification — especially when the dataset includes rare diagnoses, unusual treatment combinations, or detailed demographic profiles. The HIPAA Safe Harbor method, while legally sufficient, may not provide robust protection for a dataset this specific.

Consent scope. VitraMed's patient consent form permits data use for "research that advances medical knowledge." Patients signed this consent in the context of their clinical relationship with their doctor — they were thinking about medical research conducted by or for their healthcare providers, not commercial drug development by a pharmaceutical company. Whether pharmaceutical drug development falls within a reasonable interpretation of "research that advances medical knowledge" is legally defensible but ethically debatable.

Downstream use. If the drug succeeds, Meridian will price it according to market dynamics. Pancreatic cancer drugs typically cost $10,000 to $15,000 per month. Many of the patients whose data contributed to the drug's development may be unable to afford it. Some may have died before the drug reaches market.

Community composition. VitraMed's Midwest patient population includes significant representation from rural communities, including low-income white communities and Black communities in Detroit and other urban centers. These communities have historically justified reasons to distrust health data sharing — from the Tuskegee syphilis study to contemporary disparities in how health data is used to allocate (or deny) resources.

Corporate relationship. Mira's father founded VitraMed. She works in the university's Office of Institutional Research and has been studying data governance all semester. She is aware of the Meridian proposal and is increasingly uncomfortable with it — but she also understands the financial pressures on a startup and the genuine potential of the cancer research. Her discomfort is not simple opposition; it is the discomfort of someone who sees legitimate values on multiple sides.


Analysis Through Five Ethical Frameworks

Framework 1: Utilitarian Analysis

Central question: Does the data sharing produce the greatest overall good for the greatest number?

Utilitarian conclusion: A straightforward utilitarian calculation would likely support the data sharing. The potential benefit — a drug that could extend the lives of thousands of future cancer patients — is extraordinarily high, while the costs are probabilistic and affect a smaller number of people. The expected value calculation favors sharing.

But this conclusion depends on assumptions that may not hold. The Common Pitfall from Section 6.2.2 is directly relevant: if the probability of re-identification is underestimated, if the trust erosion cascades (patients refusing to share data with VitraMed in the future, undermining the platform's entire value proposition), or if the drug ultimately fails — the utilitarian balance shifts. Utilitarianism is only as reliable as the estimates it relies on, and in health data governance, there is a long history of underestimating tail risks.

Framework 2: Deontological Analysis

Central question: Does the data sharing respect the rights, duties, and dignity of all affected parties?

The consent question. Patients consented to "research that advances medical knowledge." A deontological analysis examines whether this consent is genuinely informed. Did patients understand that their data might be shared with a pharmaceutical company? That the company would profit from it? That they might not be able to afford the resulting product? If a reasonable patient would not have anticipated these uses when signing the consent form, then the consent — while legally valid — is not morally sufficient. As Section 6.3.2 establishes, consent that does not reflect genuine understanding of what is being agreed to undermines the autonomy that Kant considers central to human dignity.

The means/ends test. Are patients being treated merely as means? Their data is being extracted for Meridian's profit ($1.8M to VitraMed, potentially billions in drug revenue for Meridian). The patients receive no direct benefit from the data sharing itself — they are not paid, not consulted, and may not have access to the resulting drug. The research may ultimately benefit future patients, but the specific patients whose data is being used are treated primarily as data sources, not as participants in a relationship of reciprocal benefit.

A strict deontological analysis would find this problematic. Kant's second formulation requires that people be treated "always as an end and never merely as a means." The data sharing uses patients' most intimate health information for others' benefit and profit. This does not mean the sharing is necessarily prohibited — but it means that additional measures are required to treat the patients as ends: genuine informed consent for this specific use, transparency about the commercial nature of the arrangement, and ideally some form of benefit-sharing.

Deontological conclusion: The data sharing, as currently structured, does not adequately respect patient autonomy and dignity. It could be made ethically permissible through genuinely informed, specific consent and meaningful reciprocity — but not through reliance on a broad consent form signed in a clinical context.

Framework 3: Virtue Ethics Analysis

Central question: What would a person of practical wisdom do in Vikram Chakravarti's position?

A virtuous data steward would exhibit the following traits:

Honesty. A person of practical wisdom would not rely on the legal defensibility of the consent form. They would ask: "If I told my patients exactly what I plan to do with their data — share it with a pharmaceutical company for $1.8 million to support commercial drug development — would they feel respected? Or would they feel betrayed?" If the answer is uncertain, honesty requires clarification, not concealment behind legal language.

Justice. A virtuous leader would consider the distributive dimension: the patients who contribute the data are disproportionately from communities that may be unable to afford the resulting drug. Justice demands attention to this asymmetry — not just in abstract terms, but as a practical problem requiring a practical response (e.g., a patient assistance program, a commitment to equitable pricing, or a share of revenue directed to community health initiatives).

Courage. A person of practical wisdom might need to resist the financial incentive. $1.8 million is significant for a startup. Saying "we need more safeguards before we proceed" requires courage — especially when the legal team says the deal is compliant and the board wants the revenue.

Temperance. Data minimization — sharing only what Meridian genuinely needs for the pancreatic cancer study and nothing more. A virtuous approach would resist the temptation to share the full clinical database when a narrower dataset would suffice.

Virtue ethics conclusion: A CDO of practical wisdom would not reject the arrangement outright, but would insist on conditions: genuine transparency with patients, consent that specifically names the commercial partner and the commercial purpose, a benefit-sharing mechanism, and data minimization. The virtue ethics analysis does not provide a binary answer — it provides a standard of character against which the decision-maker's conduct can be measured.

Framework 4: Care Ethics Analysis

Central question: What do the relationships at stake require?

Care ethics directs attention to the specific people affected, the vulnerabilities they face, and the responsibilities that arise from the caregiver-patient relationship.

The vulnerability dimension. The 3,200 pancreatic cancer patients in VitraMed's system are in a state of profound vulnerability. They are facing a life-threatening illness. They entrusted their most intimate health information to VitraMed not as a business transaction but as part of a care relationship — they shared their diagnoses, their treatment histories, and their social circumstances because doing so was necessary for their medical care. This trust was given in a context of dependency: they needed care, and sharing data was a condition of receiving it.

To take data generated within that relationship of care and transfer it to a pharmaceutical company for commercial purposes — without explicit engagement with the patients about this specific use — is to convert a relationship of care into a relationship of extraction. Even if the legal forms are satisfied, the relational betrayal is real.

The attentiveness dimension. Care ethics asks: Has VitraMed listened to its patients? Does it know how its pancreatic cancer patients would feel about this sharing? Has it asked? The communities in VitraMed's service area — including Black communities in Detroit — have experienced betrayals of medical trust that shape how they understand data sharing. A care ethics framework would insist that VitraMed engage with these communities before making the decision, not simply consult its legal team and its board.

The responsibility dimension. Mira's instinct — that something feels wrong even though nothing is technically illegal — is precisely the kind of moral perception that care ethics validates. Care ethics trusts the ethical significance of felt discomfort when it arises from attention to relationships and vulnerability. Mira senses that the relationship between VitraMed and its patients is being instrumentalized, and that sense deserves to be taken seriously — not dismissed as naive or impractical.

Care ethics conclusion: The data sharing as currently structured fails the care ethics test because it treats a relationship of care as a resource for extraction without engaging with the vulnerable people at its center. Ethically responsible sharing would require meaningful engagement with affected patients and communities — not as a box to check, but as a genuine attempt to honor the trust relationship.

Framework 5: Justice Theory (Rawlsian) Analysis

Central question: Behind the veil of ignorance, would you accept this data governance arrangement?

The Rawlsian test asks: If you did not know whether you would be Vikram Chakravarti (the CEO who receives $1.8M), a Meridian executive (whose company profits from the drug), a healthy VitraMed patient (whose trust may be affected), or a pancreatic cancer patient in a low-income Detroit community (whose data is shared and who may be unable to afford the resulting drug) — what data-sharing arrangement would you design?

Equal basic liberties. Rawls's first principle requires equal basic liberties for all, including privacy. The current arrangement permits some patients' health data to be shared with a commercial entity based on broad consent that was not designed for this purpose. Behind the veil, not knowing whether you would be one of these patients, you would likely demand a right to specific, informed consent before any commercial data sharing.

The difference principle. Rawls's second principle permits inequalities only if they benefit the least advantaged. The current arrangement creates a significant inequality: Meridian and VitraMed benefit financially, while the patients whose data makes the research possible bear the risks (re-identification, trust erosion) and may be excluded from the benefits (if the drug is priced beyond their means). The difference principle would require that the arrangement be restructured so that its benefits reach the least advantaged: perhaps a patient assistance program guaranteeing access to the resulting drug for patients whose data contributed to its development, or a requirement that a portion of revenue be invested in community health services for the communities from which the data was drawn.

Justice theory conclusion: The current arrangement fails the Rawlsian test because its benefits flow upward (to corporations) while its risks flow downward (to vulnerable patients). It could be made just through structural safeguards: specific consent, benefit-sharing mechanisms, community engagement, and guarantees that the resulting drug is accessible to the populations whose data enabled it.


Convergences and Divergences

Where the Frameworks Converge

All five frameworks agree on several points:

  1. Legal compliance is insufficient. No framework treats HIPAA compliance as the end of the ethical analysis. Even the utilitarian framework acknowledges that legal compliance does not resolve the question of whether the arrangement is good.

  2. Consent as currently structured is inadequate. Every framework identifies a problem with relying on a broad consent form that was not designed for commercial pharmaceutical data sharing. They differ in their reasons — autonomy (deontology), trust (care ethics), fairness (justice theory), estimation quality (utilitarianism), honesty (virtue ethics) — but they converge on the conclusion.

  3. The distributive asymmetry matters. All frameworks, to varying degrees, identify the injustice of patients bearing the risks while corporations capture the benefits. This convergence across frameworks provides strong ethical ground for demanding benefit-sharing or access guarantees.

  4. Community engagement is necessary. Care ethics and justice theory are most explicit, but even virtue ethics (honesty, justice) and deontology (respect for autonomy) point toward the need for meaningful engagement with affected communities before proceeding.

Where the Frameworks Diverge

  1. Whether to share at all. Utilitarianism is the most permissive — it favors sharing because aggregate benefits appear to outweigh aggregate costs. Deontology is the most restrictive — it may prohibit sharing without genuinely specific consent. The other frameworks occupy intermediate positions.

  2. What makes the arrangement ethical. Utilitarianism focuses on outcome optimization (maximize net benefit). Deontology focuses on consent and dignity (respect autonomy). Virtue ethics focuses on the character of the decision-maker (act with integrity). Care ethics focuses on the relationship (honor trust). Justice theory focuses on distribution (benefit the least advantaged). These are different tests that may yield the same verdict but for different reasons.

  3. The weight of historical distrust. Care ethics and justice theory give this factor the most weight — because they are most attentive to vulnerability and structural disadvantage. Utilitarianism struggles to incorporate historical distrust into its calculations because the harm is diffuse and difficult to quantify.


A Reasoned Judgment

The convergence of all five frameworks on several key points provides strong ethical ground. The data sharing is not inherently wrong — the cancer research is genuinely important, and real-world evidence data can save lives. But the current arrangement is ethically inadequate because it:

  • Relies on consent that is legally sufficient but not meaningfully informed
  • Creates a distributive asymmetry that concentrates benefits on corporations and risks on vulnerable patients
  • Fails to engage the communities whose trust is at stake
  • Does not address the possibility that patients who contributed data may be unable to access the resulting drug

An ethically responsible version of the arrangement would include:

  1. Re-consent: A specific, plain-language communication to all affected patients explaining the Meridian partnership, the commercial nature of the arrangement, and the use of their data — with an opt-out option.
  2. Data governance agreement: A binding agreement with Meridian that includes purpose limitation, data destruction timelines, re-identification monitoring, and audit rights for VitraMed.
  3. Benefit-sharing: A contractual commitment from Meridian to provide a patient assistance program or reduced pricing for patients in VitraMed's system, and a commitment from VitraMed to invest a portion of the $1.8 million in community health services for the communities from which the data was drawn.
  4. Community engagement: Meaningful consultation with patient advisory groups and community representatives — particularly from communities with historical reasons to distrust health data sharing — before finalizing the arrangement.
  5. Data minimization: Sharing only the variables Meridian needs for the pancreatic cancer study, not the full clinical database.

These conditions transform the arrangement from one that is legally permissible but ethically questionable to one that is both legally compliant and ethically defensible. They represent what the six-step ethical reasoning process is designed to produce: not a single framework's verdict, but a judgment that has been tested against multiple ethical lenses and that can be transparently defended to all affected parties.


Discussion Questions

  1. The financial pressure. Vikram Chakravarti is running a startup. The $1.8 million represents significant revenue. If the conditions proposed above would delay or jeopardize the deal, is there a point at which financial survival justifies accepting less ethical safeguards? How would each framework respond to this question?

  2. The consent question. If VitraMed re-contacts patients to seek specific consent and 30% opt out, the dataset becomes smaller and potentially less useful for Meridian's research. Does the obligation to re-consent persist even if it reduces the research value? How does each framework weigh the trade-off between consent quality and research quality?

  3. The benefit-sharing dilemma. The case proposes that Meridian commit to patient access programs. But Meridian may argue that it cannot guarantee drug pricing before the drug reaches market. Is a good-faith commitment sufficient? What governance mechanisms could make benefit-sharing enforceable rather than aspirational?

  4. Mira's position. Mira is both a family member (loyalty to her father) and a data governance student (analytical distance). How should she navigate this conflict? Does any of the five frameworks provide guidance for managing personal conflicts of interest in ethical decision-making?

Option A: Stakeholder Letters. Write three short letters (250 words each): (1) from Vikram Chakravarti to VitraMed's patients, explaining the proposed data sharing and seeking consent; (2) from a patient representative to VitraMed's board, expressing concerns and proposing conditions; (3) from Meridian's ethics officer to VitraMed, responding to the proposed conditions. Each letter should reflect the ethical framework most natural to the writer's perspective.

Option B: Framework Comparison Table. Create a detailed table that applies all five frameworks to the VitraMed dilemma. For each framework, identify: (1) the central ethical question, (2) the key moral considerations, (3) the conclusion, (4) the strongest feature of the analysis, and (5) the most significant limitation. Conclude with a paragraph explaining which framework you found most illuminating and why.

Option C: Policy Draft. Draft a one-page "Ethical Data Sharing Policy" for VitraMed that operationalizes the principles from all five frameworks. The policy should include: eligibility criteria for data sharing partnerships, consent requirements, de-identification standards, benefit-sharing provisions, community engagement procedures, and governance oversight mechanisms. For each provision, note which framework(s) it reflects.
