Chapter Overview

Consider two workers in the same city, doing similar work.

The first is a warehouse fulfillment associate at a major e-commerce company. Every aspect of her shift is tracked: the time she takes to pick each item (target: 8 seconds), the distance she walks per hour (tracked by a handheld scanner), her "time off task" (any period exceeding two minutes without a recorded scan), and her overall "rate" — a composite metric that determines whether she receives a warning, a coaching session, or a termination notice. The system that tracks, evaluates, and disciplines her is fully automated. No human supervisor reviews her performance. The algorithm decides.

The second is a rideshare driver. He does not have an employer — according to the platform, he is an "independent contractor." He chooses when to work, which rides to accept, and how long to drive. But the platform's algorithm determines which ride requests he sees, how much he is paid for each ride, what his "acceptance rate" is (and the consequences of letting it drop), and his rating — a number that passengers assign and that the algorithm uses to determine future ride offers. He has no access to the data that determines his income. He cannot see the algorithm's logic, cannot appeal its decisions, and cannot negotiate its terms.

Both workers are managed by data. Neither meaningfully consented to the terms of that management. Both experience power asymmetries that would have been familiar to labor organizers a century ago — dressed in new technological clothing.

This chapter examines how data-driven systems are reshaping the world of work, connecting the themes of surveillance (Chapter 8), algorithmic decision-making (Chapter 13), accountability (Chapter 17), and digital inequality (Chapter 32) to the specific domain of labor. Sofia Reyes, whose work at the DataRights Alliance has increasingly focused on worker data rights, plays a central role.

33.1 Algorithmic Management: The Boss Is an Algorithm

33.1.1 What Is Algorithmic Management?

Algorithmic management refers to the use of data-driven automated systems to direct, evaluate, and discipline workers. Unlike traditional management — in which a human supervisor observes, communicates, and exercises judgment — algorithmic management operates through continuous data collection, real-time performance metrics, and automated decision-making.

The concept encompasses several functions traditionally performed by human managers:

Task allocation. Algorithms determine which tasks are assigned to which workers. In a ride-hailing platform, the algorithm decides which driver receives a ride request. In a warehouse, the algorithm determines the sequence of items each picker must retrieve. In a food delivery platform, the algorithm calculates routes and assigns delivery windows.

Performance monitoring. Algorithms continuously measure worker performance against predetermined metrics. These metrics are often granular (seconds per task, steps per hour, response time), opaque (workers may not know which metrics are tracked or how they are weighted), and non-negotiable (workers cannot challenge or modify the metrics).

Evaluation and discipline. Algorithms determine whether workers meet performance thresholds and implement consequences — warnings, reduced assignments, deactivation — without human review. The warehouse worker whose "rate" drops below the threshold receives an automated warning. The rideshare driver whose acceptance rate drops below the threshold sees fewer ride offers. The content moderator (Chapter 31) whose "accuracy" score drops below the threshold is placed on a performance improvement plan.

Compensation. Algorithms determine pay — in some cases dynamically, adjusting rates in real time based on supply and demand. Surge pricing, which increases fares during high-demand periods, simultaneously charges passengers more and pays drivers a variable rate that the driver cannot predict in advance.

33.1.2 The Management Black Box

A defining feature of algorithmic management is its opacity. Traditional management, whatever its flaws, generally involved communication: a supervisor could explain why a worker was being evaluated negatively, a worker could offer context or challenge a decision, and the criteria for evaluation were at least nominally transparent.

Algorithmic management often eliminates these communicative dimensions:

  • Workers may not know which metrics are being tracked
  • They may not understand how metrics are weighted or combined into composite scores
  • They may not know the thresholds that trigger consequences
  • They may not have access to a human decision-maker who can explain or override the algorithm
  • They may not have a meaningful appeals process

"This is the Accountability Gap at its most personal," Dr. Adeyemi noted. "When a human manager fires you unfairly, you can at least point to the person who made the decision. When an algorithm deactivates you, who do you appeal to? The company says it's just the algorithm. The algorithm has no phone number."

33.1.3 Nudges, Gamification, and Behavioral Control

Algorithmic management goes beyond monitoring and evaluation to actively shape worker behavior through behavioral design techniques — many of the same techniques we examined in the attention economy (Chapter 4):

Gamification. Platforms display workers' metrics as game-like elements — progress bars, streak counts, achievement badges, leaderboards. Uber shows drivers a "quest" interface: "Complete 3 more trips to earn $18 bonus!" These gamification elements leverage variable reward schedules (the same psychological mechanism used by slot machines and social media feeds) to encourage longer working hours.

Algorithmic nudges. When a rideshare driver tries to log off, the app may display a message: "You're $12 away from earning $200 today!" or "Surge pricing is active in your area!" These nudges are carefully designed to keep workers on the platform — but the platform insists the driver is "free to log off at any time."

Information asymmetry as control. Platforms control what information workers see — and when they see it. A delivery driver may not know the destination of a delivery until they accept it. A rideshare driver may not know the fare for a trip until it is completed. This information asymmetry constrains worker choice: they cannot make informed decisions about which tasks to accept because the information necessary for informed decision-making is withheld.

Callout Box: The Consent Fiction in Algorithmic Management

Platform companies argue that workers "consent" to algorithmic management by agreeing to the platform's terms of service. But this framing ignores several realities:

  • No negotiation: Workers cannot negotiate the terms of algorithmic management. They accept the platform's terms or they don't work.
  • No alternative: In many markets, a small number of platforms dominate. A rideshare driver who objects to one platform's algorithmic management may find that the alternative platform uses identical practices.
  • No transparency: You cannot meaningfully consent to a system whose rules you cannot see and whose consequences you cannot predict.
  • Dynamic terms: Platforms routinely change their algorithms, metrics, and payment structures without worker input. "Consent" to an algorithmic management system that can change at any time without notice is consent to an unknown future.

This is the Consent Fiction (recurring theme) in its most consequential form: the appearance of voluntary agreement masking a relationship of structural power.


33.2 Worker Surveillance: The Monitored Employee

33.2.1 The Surveillance Toolkit

Workplace surveillance has expanded dramatically, accelerated by the pandemic-era shift to remote work. The tools available to employers include:

Keystroke logging. Software records every keystroke an employee types, including in personal communications conducted on work devices. Some systems analyze typing patterns (speed, rhythm, error rates) to assess attention and fatigue.

Screen capture and recording. Employee monitoring software takes screenshots or continuous video of employees' screens at intervals ranging from every few seconds to every few minutes. Some systems include AI-powered analysis that categorizes screen content as "productive" or "unproductive."

Mouse tracking and activity monitoring. Systems track mouse movements, click rates, and idle time. Employees who learn these metrics are being tracked have been known to use "mouse jigglers" — devices or software that simulate mouse movement during breaks — a form of surveillance resistance that employers have, in turn, developed detection systems to identify.

Email and communication monitoring. Employers may monitor all communications on company systems, including email, Slack messages, and video calls. Some systems use natural language processing to flag communications containing specific keywords or sentiment patterns.

Location tracking. GPS tracking of company vehicles, employee phones, and wearable devices enables employers to monitor worker location continuously. Field workers, delivery drivers, and sales representatives are common targets.

Emotional analytics. An emerging category of surveillance technology claims to assess workers' emotional states through facial expression analysis, voice tone analysis, or physiological monitoring (heart rate, skin conductance). Companies like Affectiva and HireVue have developed emotional analytics tools marketed for use in hiring and performance evaluation — though the scientific validity of these tools has been widely questioned (Barrett et al., 2019).

33.2.2 The Pandemic Acceleration

The COVID-19 pandemic accelerated workplace surveillance dramatically. As millions of workers shifted to remote work, employers deployed monitoring software to replicate (and in many cases exceed) the oversight they had previously exercised through physical presence.

Demand for employee monitoring software increased by over 60% in the first months of the pandemic (Top10VPN, 2020). Products like Hubstaff, Time Doctor, ActivTrak, and Teramind saw rapid adoption, with features including:

  • "Proof of work" screenshots at random intervals
  • Activity level scores based on keyboard and mouse activity
  • Application and website tracking with "productive" and "unproductive" categories
  • "Idle time" detection that counts time without keyboard or mouse activity as unproductive

The irony was not lost on workers or researchers: the same pandemic that made remote work necessary created the conditions for a surveillance infrastructure that, in many organizations, proved more invasive than anything that existed in the physical office.

"My brother works in insurance," Eli said. "When they went remote, his company installed software that takes a screenshot every three minutes and counts how long he goes without typing. He told me he's afraid to go to the bathroom because it'll show up as 'idle time.' This isn't management. This is a digital panopticon — the exact thing we studied in Chapter 8."

33.2.3 The Evidence on Surveillance and Productivity

The business case for workplace surveillance rests on the assumption that monitoring increases productivity. The evidence is more complicated:

  • Short-term compliance increases. Surveillance does increase measurable output in the short term, particularly for tasks with clearly defined metrics (Bernstein, 2012).
  • Creativity and innovation decrease. Workers under surveillance take fewer risks, share fewer ideas, and engage in less creative problem-solving (Bernstein, 2012; Ravid et al., 2020).
  • Trust erodes. Surveillance signals distrust, which undermines the psychological safety that research identifies as essential for high-performing teams (Edmondson, 2019).
  • Turnover increases. Highly surveilled workers report lower job satisfaction and higher intention to leave (Ravid et al., 2020).
  • Counterproductive behavior increases. Workers under surveillance develop strategies to game the metrics — mouse jigglers, tab-switching, performative typing — that reduce actual productivity while increasing measured productivity.

Key Insight: Surveillance optimizes for measurable output, not valuable output. A worker who spends two hours thinking about a difficult problem before typing a solution may appear "idle" to a keystroke logger but may produce more value than a worker who types continuously for eight hours. Surveillance systems that cannot distinguish between these two patterns incentivize the latter at the expense of the former.

Legal protections against workplace surveillance vary dramatically by jurisdiction:

  • United States: Employer surveillance is broadly legal. The Electronic Communications Privacy Act (1986) permits employers to monitor communications on company systems. Many states have minimal restrictions. Notable exceptions include Connecticut and Delaware, which require employers to notify employees of email monitoring.
  • European Union: The GDPR's data minimization, purpose limitation, and legitimate interest provisions place meaningful constraints on workplace surveillance. The European Court of Human Rights has ruled that blanket workplace surveillance violates Article 8 (right to privacy) under certain circumstances (Barbulescu v. Romania, 2017).
  • Emerging legislation: California's proposed Workplace Technology Accountability Act (2023) would require employers to disclose monitoring practices, prohibit certain forms of surveillance (continuous video monitoring of remote workers in their homes), and give workers the right to access data collected about them.

33.3 The Gig Economy: Classification, Rights, and Data Asymmetry

33.3.1 The Classification Problem

The gig economy — platform-mediated work in which workers are classified as independent contractors rather than employees — represents one of the most significant labor developments of the 21st century. As of 2024, an estimated 55-60 million Americans perform some form of gig work, with approximately 16 million relying on it as their primary income (McKinsey Global Institute, 2022).

The central legal and ethical dispute concerns worker classification. Platforms classify gig workers as independent contractors, which means:

  • Workers are not entitled to minimum wage protections, overtime pay, health insurance, retirement benefits, or unemployment insurance
  • Workers bear the costs of their own equipment, fuel, maintenance, and insurance
  • Workers cannot form unions or bargain collectively under federal labor law
  • Platforms are not required to provide workplace safety protections

Platforms justify this classification by arguing that workers enjoy "flexibility" — the freedom to set their own hours, choose which tasks to accept, and work for multiple platforms simultaneously.

Critics argue that this flexibility is largely illusory:

  • Algorithmic management exercises the same functional control that defines an employment relationship — the platform determines pay, evaluates performance, allocates work, and can terminate the relationship at will.
  • The "flexibility" to set your own hours is constrained by surge pricing, quest bonuses, and algorithmic nudges that incentivize working during platform-preferred times.
  • The "freedom" to reject tasks is constrained by acceptance rate requirements that penalize selective workers.
  • The information asymmetry — the platform knows the fare, the destination, the supply/demand dynamics, the driver's history; the driver knows almost nothing — means that "choice" operates without the information necessary for informed decision-making.

33.3.2 Data Asymmetry as the Core Issue

Sofia Reyes had been investigating gig worker data rights for the DataRights Alliance for six months when she presented her findings to Dr. Adeyemi's class.

"Everyone focuses on classification — are gig workers employees or contractors?" she began. "That's important. But the deeper issue is data asymmetry. Even if you reclassified every gig worker as an employee tomorrow, the fundamental power imbalance would persist as long as the platform holds all the data and the worker holds none."

Sofia's research had identified five dimensions of gig worker data asymmetry:

  1. Earnings data. Platforms know exactly how much each worker earns, how earnings vary by time, location, and behavior, and how worker earnings compare to platform revenue. Workers know only their own earnings — they cannot compare, benchmark, or collectively bargain because they lack the aggregate data.

  2. Rating data. Worker ratings — assigned by customers and used by algorithms to allocate future work — are controlled by the platform. Workers can see their average rating but not individual ratings, cannot identify which customers rated them, and cannot challenge ratings they believe are unfair, biased, or retaliatory.

  3. Algorithmic data. The rules by which the algorithm allocates work, sets prices, and determines pay are proprietary. Workers experience the algorithm's outputs but cannot see its logic. When Uber changed its fare calculation methodology in 2022, drivers experienced income changes with no advance notice or explanation.

  4. Market data. Platforms have real-time data on supply (number of available workers) and demand (number of pending requests) across their entire market. Individual workers see only what the platform chooses to show them — typically just enough to incentivize staying online.

  5. Behavioral data. Platforms collect extensive behavioral data on workers — driving speed, braking patterns, route choices, response time, idle time — that workers cannot access. This data is used for algorithmic management, but workers have no right to see, correct, or delete it.

"If information is power — and we established in Chapter 5 that it is — then the data asymmetry in the gig economy is a power asymmetry," Sofia concluded. "Workers are data-rich but information-poor. They generate enormous quantities of data through their labor, and that data is used to manage, evaluate, and discipline them — but they have no access to it, no ownership of it, and no voice in how it's used."

33.3.3 Algorithmic Wage Discrimination

Research has identified a practice Sofia called algorithmic wage discrimination — the use of data to pay different workers different rates for substantially similar work, based on the platform's assessment of what each worker will accept.

Uber's now-defunct "route-based pricing" system (introduced in 2017 and later modified) used machine learning to predict the maximum fare a rider would pay for a given route and charged accordingly — meaning two riders taking the same route at the same time could pay different fares. While Uber stated that driver pay was based on time and distance (not rider fare), the system demonstrated the platform's capacity for personalized pricing based on individual behavioral data.

Research by Veena Dubal (2023) at UC Irvine documented what she termed "algorithmic wage discrimination" in ride-hailing platforms — personalized pay offers to individual drivers that varied based on the platform's prediction of whether the driver would accept the offer. Drivers in the same market, at the same time, performing the same work, received different pay — with the platform using behavioral data to identify drivers who would accept lower rates.

"This is the Consent Fiction applied to compensation," Dr. Adeyemi observed. "The driver 'consents' to each fare by accepting it. But they can't see the alternative fares being offered to other drivers, can't understand the algorithm determining their pay, and can't negotiate the terms. Consent without information, without alternatives, and without bargaining power is not meaningful consent."

33.4 Automation Anxiety: Evidence vs. Hype

33.4.1 The Automation Narrative

Public discourse about automation oscillates between two extremes:

The dystopian narrative: Robots and AI will eliminate most jobs, creating mass unemployment, social instability, and a world in which a small technological elite controls all productive assets while the majority of humanity becomes economically superfluous.

The utopian narrative: Automation will eliminate drudge work, freeing humans for creative, meaningful, and relationship-centered activities. New technologies create more jobs than they destroy, as they have throughout history.

Both narratives contain elements of truth. Neither is adequate on its own.

33.4.2 What the Evidence Shows

The research on automation and employment is more nuanced than either narrative suggests:

Task displacement, not job displacement. The most consistent finding is that automation displaces tasks within jobs rather than eliminating jobs entirely (Autor, 2015; Acemoglu & Restrepo, 2019). A radiologist whose diagnostic tasks are automated may shift to patient consultation, treatment planning, and complex case management. The job changes; it does not disappear.

Uneven distribution. Automation risk is not evenly distributed across the workforce. Routine cognitive tasks (data entry, basic accounting, document review) and routine manual tasks (assembly line work, warehouse picking) are most susceptible to automation. Non-routine cognitive tasks (creative work, complex decision-making, strategic planning) and non-routine interpersonal tasks (caregiving, teaching, therapy) are least susceptible.

This distribution has equity implications: routine tasks are disproportionately performed by workers with lower levels of education and income. Automation, if not managed deliberately, will widen existing inequality.

Historical precedent is incomplete. Techno-optimists cite historical precedent: the agricultural revolution, the industrial revolution, and the computing revolution all displaced workers in specific sectors while creating new employment in others. But past transitions involved decades of adjustment, significant social disruption (the Luddite movement, the Great Depression), and the eventual creation of institutions (unions, safety nets, public education) that mediated the transition's costs. There is no guarantee that the current transition will follow the same pattern — or that the adjustment period will be manageable without deliberate policy intervention.

The generative AI moment. The release of large language models (GPT-4, Claude, Gemini) in 2023-2024 introduced a new variable. Unlike previous automation waves, which primarily affected routine tasks, generative AI affects non-routine cognitive tasks — writing, analysis, coding, design — that were previously considered automation-resistant. Early evidence suggests that generative AI increases productivity for less experienced workers more than for experts (Brynjolfsson et al., 2023) and that it may compress the wage distribution rather than simply displacing low-wage workers.

33.4.3 The Hype Cycle and Responsible Analysis

"Every technology goes through a hype cycle," Ray Zhao told the class during a guest lecture on automation. "The peak of inflated expectations, the trough of disillusionment, the slope of enlightenment. We're currently at the peak of inflated expectations for generative AI. The claims that it will eliminate 300 million jobs within five years are as irresponsible as the claims that it will have no meaningful impact on employment."

Responsible analysis of automation requires:

  1. Specificity over generality. Rather than asking "will AI take jobs?" ask "which tasks within which jobs in which sectors are most susceptible to automation, over what timeframe, and with what distributional consequences?"

  2. Complementarity alongside substitution. Technology can substitute for human labor (replacing workers) or complement it (making workers more productive). Whether a specific technology acts as substitute or complement depends on design choices, organizational decisions, and policy environments — not just on the technology's capabilities.

  3. Institutional attention. The impact of automation depends not just on technological capability but on institutional context: labor market regulations, educational systems, safety nets, tax policy, and the bargaining power of workers. The same technology can produce very different employment outcomes in different institutional environments.

Connection to Chapter 13: The algorithmic systems examined in Chapter 13 — recommendation systems, content moderation algorithms, predictive models — are themselves products of the automation trend. Each system automates tasks previously performed by humans: editorial selection, content review, risk assessment. The governance challenges we've identified throughout this book — bias, opacity, accountability — are intensified when these systems replace human judgment at scale in the workplace.


33.5 Just Transition: Managing Automation Without Sacrificing Workers

33.5.1 The Concept

The term just transition originated in the labor and environmental justice movements, where it referred to the need to support workers and communities affected by the shift away from fossil fuel industries. In the context of data-driven automation, a just transition means managing technological change in ways that:

  • Protect workers who are displaced by automation from economic devastation
  • Distribute the productivity gains from automation broadly, rather than concentrating them among capital owners
  • Provide affected workers with the training, support, and time needed to transition to new forms of work
  • Ensure that the workers most affected by automation have a voice in the governance of automation

33.5.2 Policy Tools for a Just Transition

Several policy approaches have been proposed or implemented:

Education and training. Invest in lifelong learning systems that enable workers to develop new skills throughout their careers, not just in their early twenties. Denmark's "flexicurity" model combines flexible labor markets (making it easy for companies to hire and fire) with generous unemployment insurance and intensive retraining programs. The result is high labor market dynamism with relatively low worker insecurity.

Portable benefits. Design benefit systems (health insurance, retirement savings, disability insurance) that are attached to individuals rather than jobs. This is particularly important for gig workers, who currently fall through the cracks of employment-based benefit systems.

Sectoral bargaining. Enable workers in specific sectors (rideshare driving, warehouse fulfillment, delivery) to bargain collectively over the terms of algorithmic management — including the metrics used, the thresholds applied, and the consequences of falling below thresholds.

Automation taxes. Proposals by economists including Daron Acemoglu suggest taxing automation in ways that align the private incentives of firms (which save money by automating) with the social costs of displacement (which are borne by workers and communities). Such taxes would not prevent automation but would slow it where the social costs exceed the private benefits.

Universal basic income (UBI). The most radical proposal: provide all citizens with a basic income sufficient to meet basic needs, funded in part by the productivity gains from automation. Pilot programs in Finland, Kenya, and several US cities have shown mixed results — generally positive effects on wellbeing and modest effects on labor force participation.

33.5.3 Data Governance for a Just Transition

A just transition requires not just economic policy but data governance:

  • Worker data access. Workers displaced by automation should have access to the performance data, training records, and skill assessments collected about them during their employment — data that could support retraining and re-employment.
  • Algorithmic transparency in hiring. As AI-powered hiring tools become more prevalent, workers need transparency about the criteria used by these tools — particularly to challenge discriminatory patterns.
  • Automation impact assessments. Before deploying automation systems that will significantly affect employment, companies should be required to conduct and disclose impact assessments — analogous to the privacy impact assessments examined in Chapter 28.

33.6 Data Rights as Labor Rights

33.6.1 The Argument

Sofia Reyes's research at the DataRights Alliance culminated in a policy brief arguing that data rights should be recognized as a category of labor rights. Her argument rested on three pillars:

First, workers produce data. Every keystroke, every delivery, every ride, every warehouse pick generates data. This data has value — it trains algorithms, optimizes operations, and generates insights that platforms monetize. If workers produce data through their labor, they should have rights over that data — just as they have rights over other products of their labor.

Second, data is used to manage workers. The data workers produce is used to monitor, evaluate, and discipline them. If data is the mechanism through which management power is exercised, then data governance is necessarily a labor relations issue. You cannot meaningfully address workplace power imbalances without addressing the data systems through which those imbalances operate.

Third, data asymmetry undermines existing labor rights. The information asymmetries documented in the gig economy (Section 33.3) undermine workers' ability to exercise even the limited rights they currently possess. You cannot bargain effectively if you don't know what you're producing. You cannot challenge unfair treatment if you can't see the data behind the decision. You cannot organize collectively if you can't access aggregate data about working conditions.

33.6.2 Proposals

Sofia's policy brief proposed a framework of data rights for workers:

  1. Right to access. Workers should have the right to access all data collected about them during their work, in a usable format — including performance metrics, behavioral data, ratings, and algorithmic evaluations.

  2. Right to explanation. Workers should have the right to an explanation of how algorithmic management systems make decisions that affect them — including task allocation, performance evaluation, pay determination, and termination.

  3. Right to contest. Workers should have the right to contest automated decisions through a meaningful appeals process that includes human review.

  4. Right to portability. Workers should have the right to take their work data with them when they leave a platform — including ratings, performance history, and training records.

  5. Right to collective data. Workers should have the right to access aggregate data about working conditions on their platform — average earnings, rating distributions, deactivation rates — enabling collective bargaining and organized advocacy.

33.7 Sofia Reyes: From Policy to Practice

33.7.1 The Investigation

Sofia's investigation into gig worker data rights for the DataRights Alliance brought her into direct contact with the gap between policy frameworks and lived experience.

She spent three months conducting interviews with gig workers across multiple platforms — rideshare drivers, food delivery couriers, freelance designers, and home service providers. What she found was consistent across platforms and across job types:

  • No worker she interviewed had read the platform's data policy. Not because they were careless, but because the policies were impenetrably long (Uber's was over 9,000 words), frequently changed, and written in legal language that assumed expertise workers did not have.
  • No worker understood how their pay was determined. They could see individual pay amounts but could not access the logic that determined those amounts. Multiple drivers reported receiving different pay for trips they believed were equivalent — but had no way to verify whether the difference reflected a legitimate variable (traffic, route, time) or algorithmic wage discrimination.
  • No worker had successfully accessed their data. Several had submitted data access requests under the CCPA (California Consumer Privacy Act), but the data they received was either incomplete (aggregate summaries rather than raw data) or unusable (massive CSV files with no documentation or context).
  • Every worker she interviewed expressed a sense of surveillance without protection. They knew the platform was watching them — tracking their location, their speed, their idle time, their acceptance rate — but they had no corresponding ability to observe the platform's behavior. The surveillance was one-directional.

"The Consent Fiction is operating at industrial scale," Sofia reported to the class. "Millions of workers have 'consented' to data practices they don't understand, can't access, and can't challenge. We call this a market. In any other context, we'd call it an imbalance of power."

33.7.2 Toward Solutions

Sofia's investigation led the DataRights Alliance to pursue three initiatives:

Model legislation. Working with labor law academics, the Alliance drafted model legislation codifying worker data rights — drawing on the EU's GDPR framework, California's CCPA, and emerging sector-specific proposals. The model legislation has been introduced in modified form in three state legislatures as of early 2026.

Worker data cooperatives. The Alliance partnered with gig worker organizations to develop data cooperatives — collective structures through which workers pool their individual data to create aggregate datasets that enable collective bargaining. A pilot project with rideshare drivers in Chicago produced the first publicly available dataset on per-mile driver earnings by time, location, and platform.

Algorithmic audit demands. The Alliance filed formal requests — under existing transparency laws and through litigation — for independent audits of platform algorithms used to manage workers. The initial focus was on deactivation algorithms (the "firing" mechanism for gig workers) and pricing algorithms (the mechanism that determines worker pay).
