Introduction: The Compliance Officer's Double Bind
The email arrived at 9:47 on a Tuesday morning. Maya Osei, Chief Compliance Officer at Verdant Bank, had already reviewed her morning briefing — three new ICO guidance notes, a Financial Conduct Authority Dear CEO letter on operational resilience, and a stack of quarterly reporting sign-offs. But this email stopped her.
A customer had submitted a Subject Access Request under Article 15 of the UK General Data Protection Regulation. Standard procedure. Verdant's compliance team handled dozens per month.
The catch: this particular customer — call him D.K. — was the subject of an active Suspicious Activity Report filed three weeks earlier by Verdant's financial crime team. The AML SAR was with the National Crime Agency. Under the Proceeds of Crime Act 2002, tipping off D.K. that a SAR had been filed was a criminal offence carrying up to five years' imprisonment.
But D.K.'s GDPR rights were also real. He had a legal right to know what data Verdant held about him. Violating that right could expose Verdant to enforcement action by the Information Commissioner's Office, regulatory censure by the FCA, and potential claims in the civil courts.
Maya faced what practitioners call the "AML-privacy tension" — one of the most difficult intersections in financial services compliance. Before she could resolve it, she needed to understand the legal framework precisely: not approximately, not roughly, but exactly.
That precision is what this chapter is about.
Data privacy law in financial services is not a sidebar to compliance. It is structural. Every customer record, every transaction log, every risk model trained on personal data, every cross-border data transfer to a group parent company — all of it sits within a legal framework that regulates how data can be collected, processed, retained, transferred, and ultimately deleted. Getting this wrong carries regulatory consequences from multiple directions simultaneously: from data protection authorities, from prudential regulators, from financial crime authorities, and from customers exercising their rights in court.
This chapter covers the framework comprehensively: the GDPR and UK GDPR foundations, cross-border transfer mechanisms including the post-Schrems II landscape, the specific tensions between AML obligations and privacy rights, breach notification requirements, privacy-enhancing technologies, and the US state law picture. It also introduces the RegTech tooling — consent management platforms, data mapping software, and PET implementations — that make compliance tractable at scale.
17.1 GDPR Fundamentals: The Architecture of Modern Data Protection
The General Data Protection Regulation (Regulation (EU) 2016/679), which became applicable on 25 May 2018, replaced the 1995 Data Protection Directive and fundamentally restructured European data protection law. Its architecture rests on a small number of foundational concepts that practitioners must understand with precision.
17.1.1 Core Definitions
Personal data means any information relating to an identified or identifiable natural person (a "data subject"). An "identifiable" person is one who can be identified, directly or indirectly — in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to physical, physiological, genetic, mental, economic, cultural, or social identity. This definition is deliberately broad. An IP address is personal data. A bank account number, linked to its holder, is personal data. A pseudonymised identifier that can be re-linked to an individual remains personal data.
Processing means any operation or set of operations performed on personal data, whether or not by automated means. Collection, recording, organisation, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, alignment, restriction, erasure, and destruction are all processing. This breadth is intentional: GDPR covers the entire lifecycle.
Controller means the natural or legal person, public authority, agency, or other body that determines the purposes and means of processing. Processor means a natural or legal person that processes personal data on behalf of the controller. The distinction matters enormously. Controllers bear primary legal responsibility for GDPR compliance. Processors face direct obligations (primarily under Article 28 and Article 32) but are controlled by the controller's instructions.
In financial services, a bank is typically the controller for its customer data. A cloud provider running the bank's data infrastructure is typically a processor. A credit reference agency may be a controller in its own right for the data it compiles. A fintech that provides a white-label service to the bank may be either a processor (if following the bank's instructions) or a joint controller (if it independently determines processing purposes). The contractual arrangements — and the actual facts of who decides what — govern this characterisation.
17.1.2 Six Lawful Bases for Processing
Article 6 of the GDPR establishes that processing of personal data is lawful only if and to the extent that at least one of six conditions applies. These are not a hierarchy — controllers choose the basis that genuinely applies to the processing in question. Choosing the wrong basis creates legal risk even if another basis might theoretically have been available.
Consent (Article 6(1)(a)) requires that the data subject has given freely given, specific, informed, and unambiguous indication of agreement to the processing of personal data relating to them. Consent must be as easy to withdraw as to give. Pre-ticked boxes are not valid consent. Bundled consent (one tick covering multiple purposes) is not specific enough. For financial services, consent is often the wrong basis for core processing, because consent can be withdrawn, which is incompatible with the bank's need to retain data for regulatory purposes.
Contract (Article 6(1)(b)) permits processing necessary for the performance of a contract to which the data subject is party, or for pre-contractual steps taken at the data subject's request. Processing customer transaction data to execute payment instructions rests on contract. Running credit checks at a customer's application is pre-contractual. But this basis covers only what is genuinely necessary — not what is merely convenient.
Legal obligation (Article 6(1)(c)) covers processing necessary for compliance with a legal obligation to which the controller is subject. This is among the most important bases in financial services. AML transaction monitoring, mandatory regulatory reporting, tax information exchange under FATCA and CRS, and suspicious activity reporting all rest on legal obligation. The obligation must arise from EU or Member State law (or, post-Brexit, UK law), and the law must be sufficiently clear and precise.
Vital interests (Article 6(1)(d)) applies where processing is necessary to protect interests essential to life. Practically rare in financial services contexts.
Public task (Article 6(1)(e)) permits processing in the exercise of official authority vested in the controller, or necessary for a task carried out in the public interest. Relevant for regulators and public authorities; less commonly applicable to commercial banks.
Legitimate interests (Article 6(1)(f)) is available where processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject — in particular where the data subject is a child. This basis requires a three-part test: (1) a legitimate interest must exist; (2) the processing must be necessary for that interest; (3) the interest must not be overridden by the data subject's rights (a balancing test). Financial crime intelligence sharing between institutions, fraud prevention, network security, and some forms of direct marketing may rely on legitimate interests. Recital 47 confirms that the processing of personal data for direct marketing purposes may be regarded as carried out for legitimate interests. Critically, legitimate interests cannot be used by public authorities in the exercise of their tasks.
17.1.3 Data Protection Principles
Article 5 articulates six principles governing all processing. Personal data must be:
- Processed lawfully, fairly, and transparently in relation to the data subject.
- Collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes ("purpose limitation").
- Adequate, relevant, and limited to what is necessary in relation to the purposes ("data minimisation").
- Accurate and, where necessary, kept up to date ("accuracy").
- Kept in a form that permits identification of data subjects for no longer than is necessary ("storage limitation").
- Processed in a manner that ensures appropriate security of personal data ("integrity and confidentiality").
Article 5(2) adds the accountability principle: the controller is responsible for and must be able to demonstrate compliance with these principles. This documentation obligation is not aspirational — it generates enforceable duties.
17.1.4 Data Subject Rights
Chapter III of the GDPR establishes a suite of rights for individuals. These rights are real, enforceable, and carry mandatory response timelines.
Right of access (Article 15): Data subjects can request confirmation of whether their data is being processed and, if so, a copy of that data along with supplementary information (purposes, categories, recipients, retention periods, rights available). Response must be provided without undue delay and within one month, extendable by two months for complex or numerous requests (with notification within one month of why the extension applies). The first copy must be provided free of charge.
Right to rectification (Article 16): Data subjects can require correction of inaccurate personal data or completion of incomplete data without undue delay.
Right to erasure — the "right to be forgotten" (Article 17): Data subjects can request deletion where: the data is no longer necessary for the purpose for which it was collected; consent is withdrawn and no other lawful basis exists; the data subject objects and there are no overriding legitimate grounds; the data was unlawfully processed; deletion is required for compliance with a legal obligation; or the data was collected in connection with information society services offered to a child. This right is not absolute. Significant exceptions apply, including where processing is necessary for compliance with a legal obligation, for the establishment, exercise, or defence of legal claims, or for reasons of public interest in the area of public health or scientific research.
Right to restriction of processing (Article 18): Data subjects can require that processing be restricted where: accuracy is contested; processing is unlawful but the data subject opposes erasure; the controller no longer needs the data but the data subject requires it for legal claims; or the data subject has objected pending verification of whether legitimate grounds override.
Right to data portability (Article 20): Where processing is based on consent or contract and is carried out by automated means, data subjects can receive their personal data in a structured, commonly used, and machine-readable format, and can transmit that data to another controller. In financial services, this right underpins Open Banking frameworks. The portability right does not require the original controller to delete the data.
Right to object (Article 21): Data subjects can object to processing based on legitimate interests or public task at any time on grounds relating to their particular situation. The controller must cease processing unless it can demonstrate compelling legitimate grounds that override the data subject's interests. Where processing is for direct marketing purposes, the right to object is absolute — no balancing test applies.
17.2 Financial Services GDPR Specifics
17.2.1 The AML Retention vs. Erasure Tension
No tension in financial services data protection is more practically significant than the conflict between anti-money laundering data retention obligations and the GDPR right to erasure.
Under the EU Anti-Money Laundering Directives (currently the Sixth AMLD and associated regulations), and under UK AML law (the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017), firms must retain customer due diligence (CDD) records and transaction records for a minimum of five years from the end of the customer relationship (or from the date of the transaction, in relevant cases). Some jurisdictions require longer retention periods. US Bank Secrecy Act requirements create parallel obligations.
A customer who requests erasure of all their personal data under Article 17 cannot override these statutory retention obligations. Article 17(3)(b) expressly provides that the right to erasure does not apply to the extent that processing is necessary "for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject." UK GDPR contains the equivalent provision via the UK's retained version of the regulation.
However, the interaction is nuanced. The statutory obligation applies to what must be retained, not to everything the bank holds. If the bank holds customer preference data or marketing data beyond what AML requires, the erasure right may apply to that data even while AML data is retained. Firms must distinguish between mandatory retention (where legal obligation overrides erasure) and discretionary retention (where the right to erasure must be honoured).
The ICO's guidance on data retention and erasure in the financial services context confirms this approach: firms should conduct a purpose-by-purpose analysis rather than applying a blanket retention rule across all data.
17.2.2 Legitimate Interests in Financial Services
Legitimate interests is the lawful basis that financial services firms most frequently get wrong, deploying it too broadly as a catch-all basis for processing that is actually incompatible with the three-part test. The UK ICO has consistently cautioned against over-reliance on legitimate interests.
Legitimate uses in the financial services context include: fraud prevention scoring on customers' transaction patterns; security monitoring of digital banking platforms; financial crime intelligence sharing through networks such as CIFAS; analytics to identify product suitability concerns; and some forms of personalisation directly related to services the customer uses.
Where the processing is more intrusive — secondary use of data for profit, profiling for credit or insurance decisions, cross-product marketing using data obtained in a different product context — the balancing test is harder to pass, and consent or another basis may be required.
17.2.3 Special Category Data in Financial Services
Article 9 of the GDPR imposes heightened requirements on "special categories" of personal data: racial or ethnic origin, political opinions, religious beliefs, trade union membership, genetic data, biometric data processed for the purpose of uniquely identifying a natural person, health data, sex life or sexual orientation data.
Financial services firms increasingly encounter biometric data through KYC (Know Your Customer) processes. Identity verification using facial recognition against a government document photograph involves processing biometric data. Liveness detection in digital onboarding involves processing biometric data. These uses require a condition under Article 9(2) in addition to a lawful basis under Article 6. The most commonly applicable Article 9(2) conditions in financial services are: explicit consent (Article 9(2)(a)); substantial public interest in areas specified by Member State law (Article 9(2)(g)); and, where processing is by a regulated professional body, professional secrecy obligations (Article 9(2)(h)).
The FCA's guidance on digital identity verification, and the EDPB's guidance on biometric data, both emphasise that firms must document the specific Article 9(2) condition relied upon and implement appropriate technical safeguards.
17.3 UK GDPR Post-Brexit
17.3.1 The Legal Framework
When the UK left the EU, it needed to determine what would happen to its data protection framework. The solution was to incorporate the EU GDPR into UK law through the European Union (Withdrawal) Act 2018, creating the "UK GDPR" as retained EU law. This UK GDPR operates alongside the Data Protection Act 2018 (DPA 2018), which provides national implementing provisions.
The UK GDPR is substantively very similar to the EU GDPR. The rights and obligations, the six lawful bases, the accountability principles, and the enforcement structure are essentially identical. The key differences are:
- Supervisory authority: The ICO (Information Commissioner's Office) replaces the EDPB and national supervisory authorities for UK-based processing. The ICO has power to impose fines of up to £17.5 million or 4% of global annual turnover for serious infringements (mirroring the EU GDPR €20 million or 4% figure, converted and adjusted).
- Adequacy decisions: The UK government, not the European Commission, makes decisions about whether third countries offer adequate protection for UK personal data. The UK has made its own adequacy assessments independently of EU decisions.
- Data transfer mechanisms: The UK has its own version of the Standard Contractual Clauses (called the "International Data Transfer Agreement" or IDTA) and its own adequacy decision regime.
- EDPB vs. ICO guidance: The EDPB issues guidance that applies in the EU; the ICO issues guidance for the UK. Where these diverge, UK businesses must follow ICO guidance for UK processing and EDPB guidance for EU processing.
17.3.2 The UK-EU Adequacy Decision
In June 2021, the European Commission adopted an adequacy decision for the UK, finding that the UK provides an essentially equivalent level of protection for personal data to the EU GDPR. This decision means that personal data can flow from the EU to the UK without requiring Standard Contractual Clauses or other transfer mechanisms. The adequacy decision was initially granted for four years (to June 2025), subject to periodic review.
The adequacy decision has not been without controversy. Privacy advocates argued that UK surveillance laws — particularly the Investigatory Powers Act 2016 ("the Snoopers' Charter") — were inconsistent with the level of protection required for EU adequacy. The CJEU's reasoning in Schrems II (discussed in section 17.5) focused specifically on surveillance law compatibility, making UK adequacy a live legal risk.
As of 2025, the Commission renewed the UK adequacy decision following review, though the decision remains subject to ongoing monitoring by the EDPB.
17.3.3 Practical Implications for UK Financial Services Firms
For Maya at Verdant Bank, the post-Brexit framework creates a specific operational challenge. Verdant has customers in the UK and processes data in the UK, but it also uses service providers in the EU, transfers data to correspondent banks, and may have parent company reporting requirements. Each of these data flows requires analysis:
- Data flowing from UK to EU: The EU adequacy decision for the UK means EU controllers can send data to UK processors. UK controllers sending data to the EU do not face EU GDPR restrictions as exporters, but they must comply with UK GDPR as controllers.
- Data flowing from UK to third countries (neither EU nor UK-adequate): Requires use of UK transfer mechanisms (IDTA, addendum to EU SCCs, or other approved mechanism).
- EU data subjects' data processed in the UK: UK processors processing EU personal data on behalf of EU controllers must comply with EU GDPR obligations (Article 3(2) applies GDPR extraterritorially to processors not established in the EU where they process EU data subjects' data).
17.4 Cross-Border Data Transfers: The Mechanisms
Chapter V of the GDPR (Articles 44-49) governs transfers of personal data to third countries (non-EEA countries). The fundamental rule is that personal data may only be transferred to a third country if the Commission has decided that the third country ensures an adequate level of protection ("adequacy decision"), or if appropriate safeguards are in place, or if a derogation applies.
17.4.1 Adequacy Decisions
The European Commission maintains a list of countries that it has assessed as providing an essentially equivalent level of data protection. As of 2025, adequacy decisions cover: Andorra, Argentina, Canada (commercial organisations), Faroe Islands, Guernsey, Israel, Isle of Man, Japan, Jersey, New Zealand, Republic of Korea, Switzerland, the United Kingdom, and the United States (under the EU-US Data Privacy Framework, discussed in section 17.5).
Where an adequacy decision exists, data can flow to the third country as if it were within the EEA. No additional safeguards are required at the transfer level (though controllers still must comply with all other GDPR requirements).
17.4.2 Standard Contractual Clauses
Standard Contractual Clauses (SCCs) are pre-approved contract templates issued by the European Commission. When incorporated into a data transfer agreement, they provide contractual guarantees equivalent to GDPR protections. SCCs cannot be amended substantively — the model clauses must be used as issued, though supplementary provisions can be added provided they do not conflict with the clauses.
The European Commission replaced the old SCCs (adopted under the 1995 Directive) with new SCCs in June 2021, reflecting the GDPR framework and the lessons of Schrems II. The new SCCs use a "modular" structure covering four transfer scenarios: - Module 1: Controller to Controller (C2C) - Module 2: Controller to Processor (C2P) - Module 3: Processor to Processor (P2P) - Module 4: Processor to Controller (P2C)
Post-Schrems II, SCCs must be accompanied by a Transfer Impact Assessment (TIA) — an assessment by the data exporter of whether the legal framework of the destination country provides effective protection for the data being transferred. If the TIA reveals that SCCs are insufficient (for example, because surveillance laws in the destination country allow bulk access to transferred data without judicial oversight), supplementary technical measures must be implemented or the transfer cannot proceed.
17.4.3 Binding Corporate Rules
Binding Corporate Rules (BCRs) are internal corporate data protection policies that multinationals can adopt to enable personal data transfers within the corporate group. BCRs must be approved by the lead supervisory authority (coordinating with other relevant authorities). The approval process is lengthy — typically 12-24 months — and expensive, but once approved, BCRs provide a flexible and comprehensive basis for intragroup data transfers without needing SCCs for each transfer relationship.
BCRs must include specified minimum content (set out in EDPB guidelines), must be binding on all group entities, and must give data subjects enforceable rights. Cornerstone Financial Group (introduced in this chapter's second case study) explored BCRs as part of its Schrems II response — a decision that illustrates both the appeal and the limitations of BCRs in a crisis response context.
17.4.4 Derogations
Article 49 provides limited derogations for specific situations where no adequacy decision exists and SCCs or BCRs are unavailable or impractical. These include transfers: - With the data subject's explicit consent to the specific transfer, after being informed of the risks; - Necessary for the performance or conclusion of a contract with the data subject or in the data subject's interest; - For important reasons of public interest; - For the establishment, exercise, or defence of legal claims; - To protect vital interests where the data subject cannot give consent; - From a public register.
Critically, Article 49(1) states that where no adequacy decision exists, transfers may take place only on the basis of one of the specific safeguards or derogations. The EDPB has consistently cautioned that Article 49 derogations must be interpreted restrictively and cannot be used for systematic large-scale transfers — they are for exceptional situations, not routine business operations.
17.5 Schrems II and the EU-US Data Privacy Framework
17.5.1 The Schrems Saga
Maximilian Schrems, an Austrian privacy activist, has successfully challenged EU-US data transfer arrangements twice before the Court of Justice of the European Union. Each challenge reshaped the legal landscape.
Schrems I (C-362/14, October 2015): Schrems challenged Facebook Ireland's transfers of personal data to Facebook Inc. in the United States, arguing that US surveillance law (particularly following Snowden's revelations) made adequate protection impossible. The CJEU agreed, invalidating the Safe Harbor agreement that had governed EU-US transfers since 2000. Safe Harbor was replaced by the EU-US Privacy Shield in 2016.
Schrems II (C-311/18, July 2020): Schrems (now through his nonprofit noyb.eu) challenged the same Facebook transfers, this time targeting both Privacy Shield and the use of SCCs. The CJEU: 1. Invalidated the EU-US Privacy Shield, finding that US surveillance law — particularly Section 702 of the Foreign Intelligence Surveillance Act (FISA) and Executive Order 12333 — did not provide protections essentially equivalent to EU GDPR requirements. US intelligence agencies could access transferred data without judicial authorisation, and EU data subjects had no effective legal remedy. 2. Upheld SCCs in principle, but required data exporters to assess on a case-by-case basis whether SCCs provided effective protection given the legal framework of the destination country. Where SCCs are insufficient, supplementary measures must be taken or transfers must cease.
The practical consequence of Schrems II was immediate and severe. Every company relying on Privacy Shield — thousands of EU-US data transfers — was required to migrate to SCCs (or another mechanism) and conduct TIAs, immediately. Many companies had substantial technical and contractual work to do.
17.5.2 The EU-US Data Privacy Framework
In July 2023, the European Commission adopted a new adequacy decision covering the United States under the EU-US Data Privacy Framework (DPF). The DPF addressed the specific concerns the CJEU raised in Schrems II through two key mechanisms:

Executive Order 14086 (signed by President Biden in October 2022) introduced new safeguards for signals intelligence activities, including requirements of necessity and proportionality, and established a two-tier redress mechanism including a Data Protection Review Court (DPRC) — an independent body with authority to review intelligence community decisions affecting EU data subjects.

DPF Principles require participating US organisations to commit to privacy principles (similar to Safe Harbor and Privacy Shield principles) and be subject to enforcement by the US Federal Trade Commission.
The DPF is already facing legal challenge. noyb.eu announced intent to challenge the DPF immediately upon its adoption, and preliminary legal proceedings were initiated in 2023. At the time of writing, the DPF remains valid, but practitioners should monitor CJEU developments closely. The historical pattern — Safe Harbor invalidated 2015, Privacy Shield invalidated 2020, DPF challenged 2023 — suggests that EU-US data transfer is a perpetually contested legal landscape.
For firms that cannot rely on the DPF pending litigation risk, SCCs with robust TIAs remain the primary alternative.
17.6 Data Breach Notification
17.6.1 The GDPR 72-Hour Rule
Article 33 of the GDPR requires controllers to notify the competent supervisory authority of a personal data breach without undue delay and, where feasible, no later than 72 hours after becoming aware of it. If notification is not made within 72 hours, the controller must provide reasons for the delay.
Notification is required only where the breach is likely to result in a risk to the rights and freedoms of natural persons. Breaches that are unlikely to result in risk do not require supervisory authority notification (though they must be documented internally under Article 33(5)).
Where the breach is likely to result in high risk to the rights and freedoms of natural persons, Article 34 additionally requires that the controller communicate the breach to the affected data subjects without undue delay.
The notification to the supervisory authority must include, at minimum: description of the nature of the breach (categories and approximate number of individuals and records concerned); contact details of the DPO or other contact point; likely consequences of the breach; measures taken or proposed to address the breach and mitigate its effects.
The EDPB Guidelines 01/2021 on examples of data breach notifications provide detailed worked examples across multiple breach scenarios, including ransomware attacks, data loss, credential stuffing, and misdelivery of documents.
17.6.2 FCA/PRA Notification Requirements
UK financial services firms face parallel breach notification obligations to their prudential and conduct regulators. Under FCA Supervision Sourcebook (SUP) and the FCA's operational resilience framework, firms must notify the FCA of material operational incidents including cyber incidents and data breaches. The FCA expects initial notification within 24 hours of becoming aware of a material incident, with a more detailed report to follow.
The PRA maintains similar requirements for PRA-regulated firms under Fundamental Rules. The EBA Guidelines on ICT and Security Risk Management (applicable in the EU) similarly require notification to competent authorities.
Firms must therefore maintain breach response procedures that simultaneously satisfy: ICO 72-hour notification; FCA 24-hour notification; PRA notification (where applicable); and customer notification (where high risk to individuals).
These timelines are concurrent, not sequential. A firm that discovers a breach on Monday morning must be in a position to notify the ICO by Thursday morning, to notify the FCA within 24 hours, and to be assessing whether customer notification is required — all simultaneously, while also investigating the breach itself.
17.6.3 US State Breach Notification Laws
The United States does not have a single federal data breach notification law. Instead, all 50 states have enacted their own breach notification statutes, creating a patchwork of different definitions, thresholds, timelines, and requirements. Cornerstone Financial Group, operating across multiple US states, must track this patchwork carefully.
Key variations include: - What constitutes a breach: Most states define breach as unauthorized acquisition of personal information. Some require additional elements (e.g., that the acquisition was likely to result in harm). - What constitutes personal information: Usually name plus financial account number, Social Security Number, or government ID. Some states include medical information, login credentials, and other data. - Notification timelines: Ranging from "most expedient time" (no specific deadline) to 30 days (California) to 45 days (Florida) to 60 days (many states) to 90 days (some states). - Regulatory notification: Many states require notification to state attorneys general or regulators in addition to affected residents.
California's Consumer Privacy Act (CCPA) and its amendment the California Privacy Rights Act (CPRA) provide additional consumer rights discussed in section 17.8.
17.7 Privacy by Design and Records of Processing Activities
17.7.1 Privacy by Design
Article 25 of the GDPR codifies the concept of "privacy by design and by default" — originally developed by Canadian information and privacy commissioner Ann Cavoukian. The article requires controllers to implement appropriate technical and organisational measures designed to implement data protection principles effectively and to integrate the necessary safeguards into the processing.
Privacy by design means building data protection into systems from the outset — not adding it as an afterthought. Practical implementation includes: data minimisation at the architecture level (collecting only what is genuinely needed); purpose limitation enforced by system design (data collected for one purpose cannot be accessed for another without explicit controls); default privacy settings (systems default to the least privacy-invasive option); access controls that enforce need-to-know principles; audit logging of access and processing; and data quality mechanisms.
For financial services technology teams — including Priya Nair's advisory practice — Privacy by Design requirements create both technical and governance obligations. When Priya reviews a client's plans for a new customer analytics platform, she is looking for evidence that data minimisation was considered at the design stage, that retention periods are enforced automatically rather than by manual policy compliance, that access to personal data requires documented justification, and that the architecture enables data subject rights to be fulfilled (particularly the right to erasure, which requires that data can actually be located and deleted).
17.7.2 Records of Processing Activities (RoPA)
Article 30 of the GDPR requires controllers and processors to maintain a record of processing activities. The RoPA is the foundational compliance document — the inventory of what personal data the organisation processes, why, and how. Supervisory authorities can request inspection of the RoPA at any time.
For controllers, the RoPA must include: the controller's name and contact details; the purposes of processing; a description of the categories of data subjects and personal data; the categories of recipients; details of transfers to third countries and the safeguards in place; where possible, envisaged time limits for erasure; and, where possible, a general description of technical and organisational security measures.
For processors, the RoPA must include: the processor's name and contact details; the categories of processing carried out on behalf of each controller; details of transfers to third countries; and a general description of security measures.
Organisations with fewer than 250 employees are exempt from the RoPA requirement unless their processing is not occasional, or likely to result in risk to data subjects, or involves special category data or criminal conviction data. Most financial services firms — which process data on a systematic and ongoing basis — are not exempt regardless of employee count.
In practice, maintaining an accurate and current RoPA is genuinely difficult. Large financial institutions may have hundreds of processing activities, implemented across thousands of IT systems, involving dozens of processors. Data mapping — the process of identifying all data flows and processing activities — is typically a multi-month project requiring coordination across business, IT, legal, and compliance teams. RegTech tools such as OneTrust, TrustArc, and DataGrail provide purpose-built RoPA management capabilities with workflow automation, risk scoring, and regulatory change management.
17.7.3 Data Protection Impact Assessments
Article 35 requires controllers to carry out a Data Protection Impact Assessment (DPIA) before commencing processing that is "likely to result in a high risk to the rights and freedoms of natural persons." The GDPR identifies three categories that particularly require DPIAs: 1. Systematic and extensive evaluation of personal aspects relating to natural persons based on automated processing, including profiling, and on which decisions are based that produce significant effects concerning the data subject; 2. Processing on a large scale of special categories of data; 3. Systematic monitoring of a publicly accessible area on a large scale.
Supervisory authorities publish lists of additional processing types requiring mandatory DPIAs under their national guidance. The ICO's list includes: biometric identification; large-scale processing of genetic data; use of personal data to make automated decisions with significant effects; processing children's data for profiling; and others.
A DPIA must contain: a description of the processing and its purposes; an assessment of the necessity and proportionality of the processing; an assessment of risks to data subjects; and measures envisaged to address the risks and demonstrate compliance. Where a DPIA reveals high residual risk that cannot be mitigated, the controller must consult the supervisory authority before commencing processing (prior consultation under Article 36).
17.8 California CCPA/CPRA and US State Privacy Law
The California Consumer Privacy Act (CCPA), effective January 2020, introduced GDPR-like rights for California residents. It was significantly amended and expanded by the California Privacy Rights Act (CPRA), which created a dedicated California Privacy Protection Agency (CPPA) as an independent enforcement authority and added new rights effective January 2023.
Key CPRA rights include: the right to know; the right to delete; the right to opt-out of sale or sharing; the right to correct; the right to limit use of sensitive personal information; and the right not to be discriminated against for exercising privacy rights.
The CCPA/CPRA applies to for-profit businesses meeting at least one of three thresholds: annual gross revenues exceeding $25 million; buying, selling, or sharing personal information of 100,000+ California consumers or households; or deriving 50% or more of annual revenues from selling or sharing California consumers' personal information.
Beyond California, a rapidly expanding set of states have enacted comprehensive privacy laws: Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana, Iowa, Tennessee, Indiana, Florida, and others. While these laws share many structural similarities — all providing rights of access, deletion, correction, and opt-out from certain processing — they differ in significant details including scope thresholds, sensitive data definitions, enforcement mechanisms, and private rights of action (CCPA/CPRA has a limited private right of action for data breaches; most other state laws do not).
For Cornerstone Financial Group, operating across multiple states, these laws create a compliance mosaic requiring state-by-state analysis. Financial institutions subject to the Gramm-Leach-Bliley Act (GLBA) are partially exempt from some state privacy law requirements — the GLBA financial data exemption in CCPA exempts personal information that a financial institution collects, processes, sells, or discloses pursuant to, and in compliance with, the GLBA. However, the exemption is information-specific, not entity-wide, meaning financial institutions still face state law obligations for data not covered by GLBA.
17.9 Privacy-Enhancing Technologies
Privacy-enhancing technologies (PETs) are technical approaches that enable data processing while minimising privacy risks. They are increasingly relevant in financial services both as technical safeguards under GDPR's "appropriate technical measures" requirements and as tools for enabling uses of data that would otherwise be impermissible.
17.9.1 Pseudonymisation
Article 4(5) of the GDPR defines pseudonymisation as the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information — provided that such additional information is kept separately and is subject to technical and organisational measures to ensure non-attribution.
Pseudonymised data remains personal data under GDPR — it is merely reduced in risk. However, Recital 28 encourages pseudonymisation as a way to reduce risks and help controllers meet their obligations. Regulators and courts have acknowledged that pseudonymisation reduces the likelihood of harm and may affect proportionality assessments.
17.9.2 Differential Privacy
Differential privacy is a mathematical framework for quantifying and limiting the privacy loss that results from using or publishing data. A mechanism satisfies differential privacy if the probability of any output changes by at most a small multiplicative factor (epsilon) when any single individual's data is added to or removed from the dataset. Smaller epsilon values mean stronger privacy protection.
In financial services applications, differential privacy enables publication of aggregate statistics (e.g., average transaction values by region, fraud rate by merchant category) without enabling inference about specific individuals. The US Census Bureau has used differential privacy for the 2020 census. Apple and Google deploy differential privacy in their telemetry systems.
The limitation of differential privacy is that at strong privacy settings, statistical accuracy degrades. For financial regulatory reporting requiring precise numbers, differential privacy may not be applicable to the regulatory output itself — but it may be used in intermediate analytical steps.
17.9.3 Federated Learning
Federated learning is a machine learning approach where models are trained across decentralised data sources without the data leaving its source location. Instead of aggregating customer data centrally to train a fraud detection model, federated learning trains partial models on local data at each participating institution, aggregates only model updates (gradients), and produces a global model without exposing individual data.
Financial crime authorities and central banks have explored federated learning as a mechanism for cross-institution fraud and AML model training — sharing the signal without sharing the data. The European Central Bank's AML research programme has examined federated approaches. Commercial implementations include Flower, TensorFlow Federated, and PySyft.
17.9.4 Synthetic Data
Synthetic data is artificially generated data that preserves the statistical properties of real personal data without containing actual individual records. Generative Adversarial Networks (GANs) and variational autoencoders are commonly used to generate synthetic financial transaction data for model training, testing, and sharing.
Synthetic data enables model development teams to work with realistic data patterns without accessing live customer data, reducing privacy risk at the development stage. Regulators including the Bank of England and the FCA have shown interest in synthetic data for regulatory purposes. Privitar, Mostly.AI, and Gretel.ai are among the commercial providers in this space.
The key question for compliance purposes is whether synthetic data truly constitutes non-personal data or merely pseudonymised data. If a synthetic record could be re-linked to a real individual through inference or reconstruction, it may still carry GDPR implications. Rigorous synthetic data implementations include membership inference attack testing to verify that individuals cannot be identified from the synthetic dataset.
17.10 RegTech Applications: Operationalising Data Privacy
The administrative burden of GDPR compliance — maintaining RoPAs, managing DSARs, conducting DPIAs, tracking consent, managing vendor data processing agreements — is substantial enough to absorb significant compliance resources at scale. RegTech tools have emerged to automate these processes.
Consent management platforms (CMPs): Tools such as OneTrust, Cookiebot, and TrustArc automate the management of cookie consent on websites and customer consent for processing activities. CMPs maintain a log of consent signals for each data subject, enabling firms to demonstrate compliance and to withdraw processing where consent is revoked.
Data mapping and RoPA tools: Platforms including OneTrust Data Mapping, TrustArc Data Flow Manager, and DataGrail automate the discovery and documentation of personal data flows. They integrate with IT asset inventories and application portfolios to identify where personal data is processed, enabling RoPA maintenance at scale.
DSAR management platforms: Automated platforms track incoming data subject access requests, assign them to business owners, aggregate responsive data from across systems, apply redactions (including for legally exempt material), and manage response timelines. This is particularly valuable for large institutions receiving hundreds of DSARs per month.
Data discovery and classification tools: Tools such as Spirion, BigID, and Microsoft Purview scan data repositories to identify where personal data resides, classify it by sensitivity, and flag processing activities for compliance review.

One of the most practically significant GDPR questions in financial services is how regulatory reporting obligations — which require processing, retaining, and sometimes disclosing personal data — interact with data subject rights.
The answer rests primarily on Article 17(3)(b) and Article 17(3)(e): the right to erasure does not apply where processing is necessary for compliance with a legal obligation or for the establishment, exercise, or defence of legal claims.
Regulatory reporting data — transaction reports under MiFIR Article 26, suspicious transaction reports under MAR Article 16, trade reporting under EMIR, AML customer due diligence records under the AML Directives — all rest on legal obligations that override the right to erasure for the duration of mandatory retention periods.
