Introduction
In 2016, the European Union embedded in its General Data Protection Regulation a provision that would become one of the most debated clauses in technology law: the right of individuals to obtain "meaningful information about the logic involved" in automated decisions that significantly affect them. Policymakers were grappling with a problem that researchers and advocates had been raising for years — that consequential AI decisions were being made in ways that their subjects could not interrogate, challenge, or meaningfully respond to. A loan was denied. A parole recommendation was made. A medical screening flagged a patient as high-risk. And in each case, the person affected was told, in effect, that a computer had decided and no further explanation was available.
The right to understand is not merely a technical aspiration. It is grounded in principles of dignity, autonomy, and due process that run deep in both ethical philosophy and legal tradition. People have a legitimate interest in understanding decisions that shape their lives. They cannot contest decisions they cannot comprehend. They cannot correct errors they cannot identify. They cannot exercise agency in a system whose logic is opaque to them. Transparency and explainability are, at their core, preconditions for the meaningful exercise of other rights.
Part 3 moves across the full arc of this problem — from the technical reality of why modern AI systems resist explanation, through the tools that have been developed to address that resistance, to the practical and legal challenges of communicating explanations to real people in real contexts, and finally to the emerging legal frameworks that make explainability not merely desirable but required. Throughout, the part insists that the technical and the normative cannot be separated: the question of how to explain an AI decision cannot be answered without first asking who deserves an explanation, what they need it for, and what counts as an adequate account.
Why Transparency and Explainability Are Business Imperatives
The explainability conversation began largely in academic and civil society circles, but it has migrated decisively into organizational practice. Regulators on multiple continents now require that AI systems used for high-stakes decisions be explainable to affected individuals and to oversight bodies. Courts are being asked to evaluate AI-generated evidence and are increasingly skeptical of black-box systems whose reasoning cannot be examined. Customers and employees are demanding to understand when and how AI is influencing decisions that affect them. And organizations that cannot explain their AI systems face growing exposure — not just reputationally but legally and commercially.
Beyond compliance, there is an internal governance dimension to explainability that is often underappreciated. Organizations that cannot explain why their AI systems make specific decisions cannot detect when those systems are malfunctioning. They cannot perform meaningful audits. They cannot course-correct when outcomes are undesirable. Explainability is not just an external accountability mechanism — it is an internal quality control mechanism. Systems you cannot understand are systems you cannot fully control.

This chapter focuses on the human side of explainability — how to communicate AI-driven decisions to the people affected by them in ways that are accurate, accessible, and actionable. It draws on research in risk communication, plain language writing, and human-computer interaction to develop practical guidelines for explanation design, and examines case studies in which well-intentioned explanation efforts failed because they were calibrated for technical rather than lay audiences.
Chapter 16: Transparency in Marketing and Customer-Facing AI When AI systems influence the prices customers see, the products they are shown, the offers they receive, and the content that shapes their purchasing decisions, transparency questions become commercial questions. This chapter examines the ethics and regulatory context of AI-driven personalization, dynamic pricing, recommendation systems, and targeted advertising — with particular attention to the asymmetry of information between organizations that deploy these systems and the individuals who are subject to them. It asks what transparency obligations apply in commercial contexts and how they differ from the obligations that apply in high-stakes individual decisions.
Chapter 17: The Legal Right to Explanation This chapter maps the legal landscape of AI explainability obligations. It examines the GDPR's Article 22 and Recital 71 provisions, the EU AI Act's transparency requirements for high-risk systems, sector-specific requirements in financial services and healthcare, and emerging US regulatory guidance. It also addresses the gap between legal requirements and practical implementation — what "meaningful information about the logic involved" actually requires, and whether current XAI techniques are capable of satisfying that standard. The chapter closes by examining how courts in multiple jurisdictions have handled challenges to AI-driven decisions.

Explainability is not primarily a technical problem — it is a problem about the conditions under which human agency and accountability can function. The XAI techniques in Chapter 14 exist in service of normative goals that the technical work alone cannot define. A practitioner who masters the technical methods but has not thought about why explainability matters will produce explanations that satisfy engineering criteria while failing the people who need them.
Power distribution is a subtext throughout Part 3. Opaque AI systems are instruments of asymmetric power. Organizations that deploy black-box systems have information about those systems' behavior that the individuals subject to them do not. The transparency requirements discussed in Chapters 15, 16, and 17 are partly about correcting this asymmetry — giving individuals the information they need to exercise rights they formally possess but practically cannot use.
The innovation versus precaution tension appears in Chapter 13's treatment of the accuracy-interpretability trade-off. If more interpretable models perform less well, does deploying them impose costs in outcomes — worse medical diagnoses, less effective fraud detection — that must be weighed against the benefits of transparency? This is a genuine dilemma, and this part does not pretend it has an easy answer.
Who bears harms and who captures benefits is particularly salient in Chapter 16. Organizations that profit from opaque personalization and targeting systems internalize the benefits of opacity (competitive advantage, higher conversion rates) while their customers bear the costs (manipulation, uninformed decision-making, inability to contest unfavorable treatment). This distributional structure is both an ethical problem and, increasingly, a regulatory one.
Governance under uncertainty is the challenge of Chapter 17, which must grapple honestly with the fact that legal explainability requirements exist while the technical tools for satisfying them are still maturing. Organizations cannot wait for perfect XAI before they face compliance obligations, and the gap between legal requirements and technical capabilities creates genuine governance challenges.

Many AI audit practices depend on explainability methods to examine system behavior; the limitations of those methods described in Chapter 14 therefore constrain what audits can reliably establish. Readers of Chapter 19 who have not read Chapter 14 may overestimate the rigor of explanation-based auditing.
