Introduction

When a coordinated network of social media accounts spread fabricated stories about election fraud during a national election, or when health misinformation causes vaccine hesitancy that kills thousands of people, there is an understandable impulse to ask: why isn't someone doing something about this? The "someone" typically invoked is government — through law and regulation — or platforms themselves. This chapter examines what governments and platforms around the world have actually done, why they have struggled, and what principles should guide better efforts going forward.

The challenge of regulating misinformation is not merely technical or political. It is fundamentally philosophical. Any legal response to false or misleading information must confront a foundational tension in liberal democratic governance: the freedom to speak, including the freedom to be wrong, is simultaneously one of democracy's most essential features and one of its most vulnerable points. Authoritarian regimes have always understood that controlling information is central to controlling populations. Democratic governments trying to combat misinformation must somehow do so without becoming the very thing they oppose.

This chapter maps the global landscape of policy responses across six major dimensions: definitional frameworks, regulatory architecture, enforcement mechanisms, appeals and due process, interaction with free expression norms, and measurable effectiveness. It does so across multiple jurisdictions — the United States, the European Union, Germany, Singapore, Australia, India, and others — and examines both government regulation and platform self-governance.


Section 33.1: The Policy Problem — Why Misinformation Is Hard to Regulate

Before examining what policymakers have done, it is essential to understand why misinformation presents such a stubborn policy challenge. Four structural problems recur across every attempted regulatory framework: the definitional problem, the scale problem, the speed problem, and the cross-border problem.

33.1.1 The Definitional Problem

Any regulation targeting misinformation must first define what it is regulating. This proves surprisingly difficult. The terms "misinformation," "disinformation," and "malinformation" are often used interchangeably in public discourse, but scholars and policymakers have worked to distinguish them:

  • Misinformation refers to false or inaccurate information shared without the intent to deceive. The person spreading it may genuinely believe it to be true.
  • Disinformation refers to false information deliberately created and spread with the intent to deceive or manipulate.
  • Malinformation refers to information that is technically true but deployed in a context designed to cause harm — for example, selectively accurate information used to mislead.

These distinctions matter enormously for legal purposes. Criminal law generally requires intent (mens rea); a civil liability framework might not. Regulating misinformation — honest mistakes — runs immediately into the problem of chilling legitimate speech, because virtually all speakers sometimes get facts wrong.

Beyond the false/true binary, there is the problem of contested claims. Scientific uncertainty about emerging phenomena (early COVID-19 transmission dynamics, for instance), political interpretations of economic data, and predictions about future events do not fit neatly into a framework of true-versus-false. During the 2020-2021 pandemic, claims that later proved accurate — about the lab leak hypothesis, about mask effectiveness limitations, about natural immunity — were at various points suppressed by platforms applying what they understood to be the consensus scientific view.

There is also the problem of context dependency. The same statement can be accurate, misleading, or false depending on framing, audience, and distribution mechanism. A statistic accurately describing one population becomes misinformation when applied to another. Satire that is clearly labeled as such in one context can circulate stripped of that label, becoming false information.

Finally, legal definitions of misinformation risk creating a government-controlled epistemology — an official version of truth that must be accepted under penalty of law. This is precisely the mechanism authoritarian states have used to suppress inconvenient facts, political criticism, and minority viewpoints throughout history.

33.1.2 The Scale Problem

Even setting aside definitional difficulties, the sheer volume of online content makes meaningful human review impossible. As of 2023, approximately 500 hours of video are uploaded to YouTube every minute. Facebook processes over 100 billion messages daily. Twitter/X hosts hundreds of millions of tweets per day. Instagram, TikTok, Reddit, and countless other platforms add billions more pieces of content.

No government regulatory body and no platform content moderation team can review content at this scale in a way that allows for thoughtful, context-sensitive, individualized decisions. Automation is therefore essential — and automation introduces its own problems. Machine learning classifiers trained to detect misinformation patterns will generate false positives (removing legitimate speech) and false negatives (allowing harmful content to remain). These error rates, applied at platform scale, translate into millions of incorrect decisions daily.

The scale problem also affects the judicial and appeals processes that free speech frameworks typically require. If a platform removes a million pieces of content per day, providing meaningful appeals for each removal — the kind of hearing a court or administrative tribunal might offer — is logistically impossible. Yet without appeals, error correction is severely limited.

33.1.3 The Speed Problem

Misinformation typically spreads fastest in the hours immediately after a triggering event — a mass shooting, a political scandal, a natural disaster — before accurate information is available. Research by Vosoughi, Roy, and Aral (2018) in Science found that false news spreads significantly faster than true news on Twitter, reaches more people, and penetrates deeper into social networks. The researchers attributed this in part to the novelty of false information: fabricated stories tend to be more surprising and emotionally engaging than accurate reporting.

This speed asymmetry creates a policy timing problem. Even a regulator or platform with excellent detection capabilities will be working after the fact, removing or labeling content that has already spread to millions of viewers. The viral cascade has already occurred; the correction arrives too late. Content moderation policies designed around detection and removal therefore address a problem that has already done its damage.

Some researchers have proposed proactive approaches — prebunking, friction-adding interventions, or interstitials that pause before sharing — as more effective than reactive removal precisely because they intervene before the viral spread. But these approaches raise their own concerns about government or platform paternalism.

33.1.4 The Cross-Border Problem

The internet does not respect national borders. A piece of disinformation produced in one country, hosted on servers in a second, amplified by automated accounts registered in a third, and consumed by audiences in a fourth creates a jurisdictional puzzle that national law is poorly equipped to address. The coordinated inauthentic behavior campaigns documented by Facebook, such as those linked to the Internet Research Agency in St. Petersburg, Russia, operate across multiple jurisdictions with different legal frameworks and enforcement capacities.

Even when a government has jurisdiction over a platform — because the platform has offices, users, or assets in its territory — the extraterritorial reach of national law is contested. The EU has been most aggressive in asserting that platforms serving European users must comply with European law regardless of where they are headquartered, and the DSA extends this logic substantially. But enforcement against platforms headquartered in countries that don't recognize European jurisdiction remains difficult.

The cross-border problem also means that national regulations can be evaded. Content removed from one platform may reappear on another. Content takedowns in one country may simply shift production and distribution to jurisdictions with different rules. This "whack-a-mole" dynamic is a persistent frustration for regulators.


Section 33.2: Free Speech Frameworks — Constitutional Foundations

33.2.1 First Amendment Absolutism and US Exceptionalism

The United States has the world's most speech-protective constitutional framework. The First Amendment to the US Constitution prohibits Congress — and by incorporation through the Fourteenth Amendment, all levels of government — from making laws "abridging the freedom of speech, or of the press." The Supreme Court has interpreted this provision broadly, finding that speech can only be restricted if the government demonstrates a compelling interest and that the regulation is narrowly tailored to serve that interest.

Critically, the Supreme Court has consistently rejected the proposition that false speech is categorically unprotected. In United States v. Alvarez (2012), the Court struck down the Stolen Valor Act, which criminalized false claims about receiving military honors. The plurality opinion, written by Justice Kennedy, held that the government cannot create "a Ministry of Truth" to police false statements of fact, absent proof of legally cognizable harm. False statements may have some value — they produce the corrective discourse of their exposure, for instance — and the government's interest in "an accurate historical record" is insufficient to justify criminal sanction.

This constitutional framework means that most direct government regulation of online speech in the United States is constitutionally infeasible. A law requiring platforms to remove "misinformation" would be subject to First Amendment challenge both on behalf of the platform (if compelled to remove its own editorial choices) and on behalf of the speakers whose content is removed (through overbreadth claims). The government's ability to combat misinformation through law is therefore substantially confined to: (a) its own counter-speech, (b) regulating its own employees and contractors, (c) fraud and defamation in contexts involving concrete harm, and (d) foreign government influence operations that implicate national security law.

33.2.2 European Rights-Balancing: ECHR Article 10

The European approach to free expression differs fundamentally in structure from the US approach, even though both frameworks nominally protect freedom of expression. Article 10 of the European Convention on Human Rights (ECHR) provides:

"Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers."

But Article 10(2) immediately qualifies this:

"The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others..."

This "rights-balancing" approach treats free expression as one important right among several that must be weighed against competing interests. The European Court of Human Rights has upheld restrictions on expression that would be clearly unconstitutional in the United States, including criminal penalties for Holocaust denial (in Garaudy v. France, 2003, declared inadmissible as manifestly ill-founded) and restrictions on speech denigrating religious beliefs.

The EU Charter of Fundamental Rights similarly provides in Article 11 for freedom of expression and information, while Article 52 allows for limitations that are "necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others."

This structural difference means that European law can engage in proportionality-based regulation of online speech in ways that would fail constitutional muster in the United States. The EU's Digital Services Act, the GDPR, and various national laws like Germany's NetzDG all operate within this more permissive constitutional framework.

33.2.3 Hate Speech Laws as Precedent

Most European and many other democracies have enacted hate speech laws that prohibit speech targeting individuals or groups based on protected characteristics — race, religion, ethnicity, sexual orientation, and similar categories. These laws serve as both legal precedent and conceptual model for misinformation regulation, in that they demonstrate democracy can survive limits on certain categories of speech.

However, the hate speech precedent is imperfect for misinformation regulation. Hate speech laws typically target speech that targets persons based on identity — speech that degrades, threatens, or incites against a group. The legal wrong is the targeting, not a false factual claim. Misinformation regulation would need to regulate the content of factual assertions, which raises distinct and arguably more difficult questions about government epistemological authority.

The hate speech precedent also comes with its own documented problems: overuse against minority communities, disparate enforcement, and chilling effects on legitimate political speech. These same pathologies are likely to appear in misinformation regulation, magnified by the scale and contextual complexity of online information.


Section 33.3: The US Approach — Section 230 and Its Alternatives

33.3.1 Section 230 of the Communications Decency Act

The central feature of US internet regulation — and the reason American platforms have operated under a fundamentally different legal regime than their European counterparts — is Section 230 of the Communications Decency Act of 1996. The key provision, 47 U.S.C. § 230(c)(1), reads:

"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."

This provision gives platforms immunity from liability for the speech of their users. A newspaper can be sued for libel if it publishes a defamatory article; Facebook cannot be sued for defamation when a user posts defamatory content. Section 230 also provides immunity for good faith moderation: platforms that remove content they find objectionable, or that fail to remove content, are protected from liability either way.

Section 230's defenders argue that it is the legal foundation of the modern internet: without immunity from liability for user content, platforms would face impossible choices between not hosting user content at all or being liable for hundreds of millions of posts. The law enabled the creation of user-generated content platforms — social media, review sites, forums, online marketplaces — by removing the liability risk that would have made them untenable. Section 230(c)(2) further protects platforms' editorial discretion, ensuring they can moderate without becoming "publishers" who inherit liability for all content.

Section 230's critics argue that the immunity it provides has allowed platforms to profit from the spread of harmful content, including misinformation, without bearing any of the costs. When Facebook's algorithms amplify health misinformation that leads to vaccine refusals and preventable deaths, Section 230 means Facebook faces no legal consequences. Critics argue this creates perverse incentives: engagement-maximizing algorithms that favor sensational and outrage-inducing content, including misinformation, because such content generates more interaction.

33.3.2 Section 230 Reform Proposals

Congressional proposals to modify Section 230 have come from both political parties, though with very different objectives:

The EARN IT Act (Eliminating Abusive and Rampant Neglect of Interactive Technologies), first introduced in 2020 and reintroduced in subsequent sessions, would condition Section 230 immunity on platforms complying with a set of best practices for preventing child sexual abuse material (CSAM). Critics argued the original version would effectively require platforms to implement backdoors in encryption, a position backed by law enforcement but strongly opposed by security researchers and civil liberties advocates. Revised versions attempted to address this concern.

The PACT Act (Platform Accountability and Consumer Transparency Act) would require platforms to publish content moderation policies and apply them consistently, with transparency reporting requirements and appeals processes. This represents a procedural rather than substantive regulation — platforms must do what they say they will do, but are not told what to say.

Republican proposals following the 2020 election and subsequent platform decisions to restrict accounts sharing election misinformation focused on stripping Section 230 immunity from platforms that engage in "political censorship." These proposals reflected a view that platforms were systematically biased against conservative speech — a claim that independent researchers have disputed but that has significant political salience.

Progressive proposals focused on conditioning immunity on platforms taking reasonable steps to prevent algorithmic amplification of harmful content, including health misinformation and coordinated inauthentic behavior.

As of 2024, Section 230 remains substantially intact, though its status remains contested and legislative proposals continue to emerge.

33.3.3 FTC Authority and Political Advertising

The Federal Trade Commission (FTC) has authority over deceptive trade practices under Section 5 of the FTC Act. Some scholars have argued that platforms could be held to account for deceptive content moderation representations — for instance, if a platform claims to remove health misinformation but systematically fails to do so, that could constitute a deceptive practice. The FTC's authority in this area has not been tested through litigation in the context of misinformation.

The Federal Election Commission (FEC) regulates political advertising, including disclosure requirements for "paid for by" attributions in political ads. However, FEC jurisdiction does not extend to organic (non-paid) political speech, and the agency's regulations have historically lagged platform advertising formats. Dark advertising on social media — highly targeted ads that are visible to their intended audience but not to the general public or journalists — has been difficult for the FEC to monitor.


Section 33.4: The European Union — A Comprehensive Regulatory Framework

33.4.1 The Digital Services Act (DSA), 2022

The EU Digital Services Act, which entered into full force in 2024 after phased implementation beginning in 2023 for the largest platforms, represents the most comprehensive government attempt to regulate online content at scale in any major democracy. The DSA replaces the 2000 E-Commerce Directive and creates a tiered regulatory framework applicable to all digital intermediary services operating in the EU.

The DSA's key provisions include:

Illegal content obligations: All platforms must have mechanisms for users to flag potentially illegal content and must act on notices of illegal content expeditiously. The DSA does not itself define what is illegal — it relies on existing national and EU law — but it creates enforcement mechanisms for those definitions.

Transparency requirements: Platforms must publish transparency reports on content moderation, provide reasons for moderation decisions to affected users, and maintain accessible repositories of advertising.

Algorithmic accountability: Very Large Online Platforms (VLOPs) — those with more than 45 million EU active users — must conduct annual risk assessments of their algorithmic systems and implement risk mitigation measures. For misinformation specifically, this means platforms must assess and address systemic risks from their recommendation algorithms.

Researcher access: VLOPs must provide vetted researchers access to platform data for research purposes. This provision addresses a long-standing obstacle to academic study of algorithmic amplification of misinformation.

Independent audits: VLOPs must submit to annual independent audits of their risk mitigation measures.

Prohibitions on certain dark patterns: The DSA prohibits recommender systems and advertising practices that exploit users' psychological vulnerabilities.

Enforcement is shared between national Digital Services Coordinators and the European Commission, with the Commission having direct enforcement authority over VLOPs. Penalties can reach 6% of global annual turnover for serious violations, and 1% for less serious ones.

The DSA is notably agnostic on content — it does not require platforms to remove specific types of content beyond what is already illegal under member state law. Its approach to misinformation specifically is risk-based: platforms must assess whether their systems create systemic risks around "actual or foreseeable negative effects on... civic discourse or electoral processes." If risks are identified, mitigation measures must be implemented and audited.

33.4.2 GDPR Implications

The General Data Protection Regulation (GDPR), in force since 2018, affects misinformation indirectly through its restrictions on micro-targeted advertising. Micro-targeting — delivering highly customized messages to narrow audiences based on detailed behavioral profiles — has been identified as a key mechanism for disinformation campaigns, which can tailor messages to exploit specific audiences' concerns and fears.

GDPR requires a lawful basis for processing personal data used in targeted advertising. The Article 9 prohibition on processing "special categories" of data (including political opinions, health data, and religious beliefs) without explicit consent has limited advertisers' ability to micro-target based on these sensitive categories. Critics argue these protections have been inadequately enforced and that major platforms continue to enable targeting based on inferred sensitive characteristics.

33.4.3 The Code of Practice on Disinformation

The EU's Code of Practice on Disinformation is a voluntary self-regulatory instrument that has existed since 2018, with a significantly strengthened version adopted in 2022. Signatories — including Google, Meta, Twitter/X (prior to its eventual withdrawal), Microsoft, TikTok, and dozens of smaller platforms — commit to specific actions to combat disinformation.

The 2022 strengthened Code includes commitments on: demonetizing disinformation, ensuring transparency in political advertising, empowering researchers, promoting media literacy, and transparency reporting against specific, measurable commitments.

The Code operates under the DSA's framework as a "code of conduct" and provides a compliance pathway for VLOP risk mitigation obligations. However, enforcement of voluntary commitments remains limited — signatories who fail to meet their stated commitments face reputational consequences but limited legal penalty.

33.4.4 The AI Act

The EU AI Act, adopted in 2024, creates a risk-tiered regulatory framework for artificial intelligence systems. Certain AI applications relevant to misinformation — including AI-generated deepfakes — are subject to mandatory disclosure requirements. AI systems that generate or manipulate content must be clearly labeled as AI-generated when used to create "deep fakes" (synthetic audio or video of real people). General-purpose AI models above certain capability thresholds face additional transparency and safety assessment requirements.


Section 33.5: Germany's NetzDG — Mandatory Removal and Its Discontents

33.5.1 The Network Enforcement Act

Germany's Netzwerkdurchsetzungsgesetz (NetzDG), enacted in 2017, was one of the first national laws to impose mandatory removal obligations on social media platforms. It applies to platforms with more than 2 million registered users in Germany and requires them to:

  • Remove "obviously illegal" content within 24 hours of a valid complaint;
  • Remove content that is illegal under German law within 7 days (though the window can be extended for difficult cases requiring review);
  • Establish effective complaint procedures;
  • Publish biannual transparency reports.

The categories of illegal content covered by NetzDG are those defined as crimes under existing German law, including: incitement to hatred (§130 StGB), spreading propaganda of unconstitutional organizations, Holocaust denial, and various forms of defamation and threats. NetzDG does not create new categories of illegal speech — it creates a mandatory enforcement mechanism for existing criminal categories.

Penalties for non-compliance are substantial — up to €50 million for systematic failure to maintain adequate complaint procedures.

33.5.2 The Chilling Effects Debate

NetzDG has been criticized on two contradictory grounds that together illustrate the fundamental dilemma of content moderation at scale:

Criticism 1: Over-removal and chilling effects. Because platforms face large penalties for failure to remove illegal content but face no penalty for over-removal, incentives push toward erring on the side of removal. Early studies found evidence of over-removal: political satire, journalistic commentary, and protected speech was being removed alongside genuinely illegal content. The 24-hour deadline for "obviously illegal" content makes nuanced contextual judgment difficult. Platforms processing thousands of complaints daily have strong incentives to remove whenever in doubt.

Criticism 2: Under-removal. Simultaneously, researchers found that hate speech and extremist content continued to circulate widely on German social media platforms despite NetzDG. The law's narrow scope (only content illegal under German law) and the difficulty of detecting violations systematically meant that much harmful content was never complained about and therefore never reviewed.

These contradictory findings suggest that NetzDG functions primarily as a complaint-processing system that responds to reported content rather than proactively reducing the overall prevalence of illegal speech. Its effect on the information environment may be less than proponents hoped and its effect on legitimate speech greater than critics fear — but both effects are real.

33.5.3 NetzDG as a Model

Despite its controversy, NetzDG has served as a template for legislation in other countries. Austria, France (though France's version was struck down by its Constitutional Council in 2020), Kenya, and others have enacted or proposed similar mandatory removal laws. The spread of the NetzDG model illustrates a key concern of international human rights law: laws designed within a relatively robust democratic and judicial framework may be copied into contexts where those safeguards do not exist.


Section 33.6: Asia-Pacific Responses

33.6.1 Singapore's POFMA

Singapore's Protection from Online Falsehoods and Manipulation Act (POFMA), enacted in 2019, is one of the most powerful and controversial anti-misinformation laws enacted in any nominal democracy. POFMA gives the Singapore government sweeping authority to issue correction directions and removal directions for content it determines to be false.

Key features of POFMA include:

Ministerial authority: Any government minister can issue a correction direction requiring a platform or individual to attach a correction notice to allegedly false content. The minister issues the direction; there is no prior judicial review.

Broad scope: POFMA applies to any statement that is false in fact and where the minister is "satisfied" that it is in the public interest to issue a direction. "Public interest" is defined broadly to include public health, national security, and "public tranquillity" — a category that could encompass a wide range of political speech.

Swift appeals: A recipient of a direction can appeal to the High Court, but only after the correction direction has already been issued and attached to the content. The correction notice appears immediately; judicial review occurs after the fact.

Platform obligations: Platforms must comply with directions promptly. Non-compliance can result in substantial penalties and orders blocking access to the platform in Singapore.

33.6.2 Australia's Online Safety Act

Australia's Online Safety Act 2021 created a new regulatory framework for online content, administered by the eSafety Commissioner. The Act includes:

  • A basic online safety expectations framework requiring large platforms to take reasonable steps to minimize certain categories of harmful content;
  • A complaints scheme covering cyberbullying, image-based abuse, and other personal harms;
  • Removal orders for "seriously harmful" content;
  • Industry standard-making powers allowing the eSafety Commissioner to mandate industry-wide technical and procedural measures.

Australia's approach is focused more on individual safety harms (cyberbullying, abuse) than on political misinformation per se, though the framework is broad enough to encompass various types of harmful content.

33.6.3 India's IT Rules 2021

India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 imposed significant new obligations on social media intermediaries, including requirements to:

  • Appoint resident grievance officers, compliance officers, and nodal officers physically present in India;
  • Respond to government orders for user information within 72 hours;
  • Enable identification of the "first originator" of messages in end-to-end encrypted messaging platforms — effectively requiring a backdoor in encrypted communications;
  • Maintain records of users and content for specified periods.

The first originator requirement — applying to significant social media intermediaries including WhatsApp — was challenged in court by WhatsApp and other platforms, who argued it would require breaking end-to-end encryption. The legal proceedings continued for several years.

33.6.4 Authoritarian Uses of Anti-Misinformation Laws

The documented use of anti-misinformation laws to suppress political dissent represents one of the most serious concerns about the global spread of such legislation. Freedom House, Reporters Without Borders, and Article 19 have documented numerous cases:

  • Egypt: Emergency laws and cybercrime legislation used to arrest journalists and activists for social media posts;
  • Myanmar: Anti-misinformation provisions used against activists before the 2021 coup, and extensively used by the military junta thereafter;
  • Tanzania, Ethiopia, Cambodia: Various "false news" provisions used against opposition politicians, independent journalists, and civil society organizations;
  • Russia: Legislation ostensibly targeting "fake news" about COVID-19, and later about the invasion of Ukraine, used to criminalize any characterization of the war that differed from official government framing.

The pattern is consistent: laws drafted with stated justification of combating harmful misinformation are used primarily or extensively against government critics and political opponents. This pattern is not accidental — it reflects the structural reality that governments control enforcement and have political interests in suppressing inconvenient speech.


Section 33.7: Self-Regulation and Co-Regulation

33.7.1 Platform Voluntary Commitments

In the absence of comprehensive government mandates, major platforms have adopted voluntary policies addressing misinformation. These policies vary significantly across platforms but typically include:
