Case Study 2 — The Ceiling Tile: A Firestopping Gap Found Three Days Before Occupancy

All people, companies, and projects in this book are illustrative composites. The costs are constructed to teach the arithmetic honestly; the failure mode is entirely real and I have watched versions of it on four different projects.


Setup

Where we are. Northgate Outpatient Pavilion, September, Year 2. Substantial completion was achieved on September 18 — on the contract date, after 565 calendar days, a 23-day steel delay, an acceleration, a change order that got built before it was priced, and a storefront rework in month fourteen. Certificate of occupancy is scheduled for September 24. Meridian's move-in crews are staged. The imaging service line has patients scheduled beginning September 29.

The scope in question. Firestopping — the materials and systems that restore the fire and smoke resistance of a rated wall or floor wherever something interrupts it. Two categories matter here, and the distinction is the whole case:

The scope gap, born in buyout, month five. Kestrel bought a dedicated firestopping subcontractor rather than making each trade firestop its own penetrations — usually the better call, because it puts one qualified party in charge of a life-safety system instead of eleven.

Bulwark Firestop's scope sheet said: through-penetration firestopping at rated walls and floors for mechanical, electrical, plumbing, fire protection, and communications penetrations.

Summit Interior Systems' scope sheet said: rated partitions constructed per the listed assemblies indicated on the drawings, and, under exclusions: firestopping by others.

Read those two together. Head-of-wall joints are in neither. Bulwark read "penetration" literally and excluded joints — which is defensible, because a joint is a different system with a different listing. Summit read "firestopping by others" as covering everything with the word firestop in it — also defensible. Kestrel's project engineer, comparing the two scope sheets in buyout, ticked the box because both sheets contained the word "firestopping" and neither said "not included."

The gap did not live inside either subcontract. It lived in the space between them — which, as Chapter 16 puts it, is exactly where scope gaps always live, and exactly what the general contractor is paid to own.


What Happens

September 21, 9:40 a.m. — the ceiling tile

Fire Marshal Odalys Prieto is doing her final life-safety walk with Margo, Dani, and Meridian's facilities director. Level three, north clinic corridor. She stops under a smoke barrier, points at the ceiling, and asks for a ladder.

She lifts one 2×2 tile.

Above it, a 1-hour-rated smoke barrier partition runs to the underside of the metal deck. At the top of the partition there is a gap between the track and the deck flutes, roughly three-quarters of an inch, running the length of the wall. It is open. No joint spray, no strip, no putty, nothing.

She puts the tile back. She walks 40 feet and lifts another. Same condition. She lifts three more. Two are open; one has been sealed with a bead of ordinary acoustical sealant, which is not a fire-resistive joint system and has no listing for that condition.

Prieto: "Margo, I'm going to stop here. I'm not going to keep pulling tiles on a building I can't approve. Who did your joints?"

Margo: "Bulwark."

Prieto: "Get their submittal. And get me the assembly listing for that wall, because whatever's above that tile isn't in it."

Dani calls Tanya Oyelaran at Bulwark from the corridor.

Tanya: "We did every penetration in that building. Two thousand four hundred and something. We didn't do head-of-wall. It's not in our scope — go look at our proposal, page two, second bullet. We priced penetrations."

Dani: "Did anybody ever ask you about head-of-wall?"

Tanya: "Nobody ever asked me about head-of-wall."

She was telling the truth, and she had said the same thing at the buyout meeting in month five, where it was written into the scope sheet and read by nobody afterward.

September 21, 2:00 p.m. — bounding the extent

Margo, Dani, and four superintendents spend the afternoon lifting ceiling tiles across all four floors. The finding:

Two facts made the next three days brutal.

First, the ceiling was already up everywhere. Access to 1,880 LF meant lifting and reinstalling several thousand ceiling tiles, working from lifts in occupied-ready finished space, protecting new flooring, and re-cleaning everything afterward.

Second, 260 LF was above hard ceilings — gypsum lids with no access panels, because access panels were never required for a scope nobody knew existed. And 14 of those locations were the lead-lined gypsum ceilings in the imaging suite, the radio-frequency shielded construction that came out of change order #14 when Meridian's vendor selected a different MRI unit after the GMP was set. Cutting a shielded ceiling means repairing the shielding, and repairing the shielding means re-verifying it, and the vendor who verifies it does not work weekends on twelve hours' notice.

September 21, 5:30 p.m. — the call with the owner

Ray: "Pri, I'm going to give you the whole thing at once. We have a scope gap. Head-of-wall firestopping was in nobody's subcontract. It's ours. Twenty-one hundred feet. About eighteen hundred of it is accessible and we can surge it. Two hundred sixty feet is above hard ceilings, and fourteen of those locations are in the shielded imaging ceilings."

Pri: "Say the date."

Ray: "For the building minus the imaging suite, I think we hold September twenty-fourth. For imaging, I don't have a date yet. I'll have one tomorrow at noon, and it will not be a guess."

Pri: "I have patients scheduled on the twenty-ninth."

Ray: "I know. I'm not going to tell you we'll make that."

That call is the only genuinely well-executed thing Kestrel did in this entire case study, and it is worth naming why. Ray gave the bad news whole, on the day it was known, with the parts he could not yet answer clearly labeled as unanswered — and he did not promise a date he had not earned. Relationships survive bad news delivered early. They do not survive bad news delivered late in installments.

September 21–24 — the surge

Bulwark mobilized three crews on a 24-hour rotation. Summit provided ceiling-tile access crews. Kestrel ran two superintendents around the clock.

By 4:00 p.m. on September 24, all 1,880 LF of accessible head-of-wall joint was installed per the listed system, inspected by a third-party firestop inspection agency Kestrel engaged on twelve hours' notice, and photographed location by location.

Fire Marshal Prieto re-inspected on the afternoon of September 24 and, with the imaging suite excluded from the approved area, cleared the life-safety portion of the occupancy approval. Frank Petrosyan issued the certificate of occupancy on September 24, Year 2 — the contract date — with the imaging suite held out.

The imaging suite's amended certificate came on October 11, Year 2: seventeen days later, after 62 access cuts, hard-lid patching and repainting, lead-lined gypsum replacement at 14 locations, radio-frequency shielding repair, and shielding re-verification by the vendor.

Meridian's imaging service line opened twelve days behind schedule. Patients scheduled for September 29 were rescheduled by Meridian's staff, one phone call at a time.

Who paid

Kestrel's $181,500 came out of a CM fee of $1,804,800 — a 10.1% reduction in the fee for the entire project, produced by a line item that was never bought.

No liquidated damages were assessed. Substantial completion of the work was achieved on September 18 per the contract, and the LD clause on this project attaches to substantial completion, not to the certificate of occupancy. Kestrel was fortunate in that, and Ray knew it: on a contract that had defined substantial completion as requiring an unrestricted certificate of occupancy, this event would have run seventeen days at $5,500 per calendar day — $93,500 of liquidated damages on top of everything above, and a conversation with the surety.


Analysis

Three failures, in order of importance

1. The scope gap, month five. Two scope sheets, both accurate about themselves, describing a boundary neither one crossed. This is the ordinary, unglamorous, extremely expensive failure mode of buyout, and the fix is a discipline, not a form: when you compare scope sheets, do not look for what each one says. Look for what neither one says. Read the two exclusion lists against each other. The Kestrel project engineer who ticked this box had both documents in front of him and read them as a checklist rather than as a boundary.

2. No ITP line for rated assemblies, month eleven. Kestrel's quality plan had a close-in release as a hold point for the exterior wall assembly — that is the line in the chapter's inspection and test plan, and it worked. There was no equivalent hold point before interior ceilings closed. Nobody ever stood in a corridor with a checklist that said rated partitions: head-of-wall joint installed and inspected — release to install ceiling grid.

If that one line had existed, the gap would have surfaced in month eleven, when the first ceiling went up in the first area, at a cost of approximately $31,030 plus a two-week argument about whose subcontract it belonged in. Instead it surfaced in month nineteen at $230,530, plus a hard ceiling, plus a shielded ceiling, plus a fire marshal.

3. No third-party firestop inspection, ever. Many projects specify independent inspection of firestopping. Northgate's did not require it, and Kestrel did not volunteer it. The agency Kestrel eventually engaged in a panic on September 21 — for $22,800 — would have cost roughly the same amount if it had been engaged in month ten, and would have found this in its first week.

The access lesson, which is really a sequencing lesson

Here is the part that separates the $31,030 version from the $230,530 version, and it has nothing to do with firestopping.

The firestopping itself is $31,030 in both columns. Everything else — $199,500 — is the price of reaching the work. That is the general law behind every quality decision in this book: the cost of correcting a defect is a function of how much finished work sits between you and it. It is why hold points exist, why close-in releases exist, and why a twenty-minute walk before a ceiling closes is the highest-return twenty minutes on a project.

Compare it to the storefront

The two case studies in this chapter fail differently, and putting them side by side is the point.

The second one is worse, and not because of the number. A storefront head that does not match a mockup is a defect in what the owner bought. An unfirestopped head-of-wall joint in a smoke barrier is a defect in whether the building protects people who are asleep, sedated, or on a gurney. The rated assembly exists so that smoke stays on one side of a wall long enough for a nurse to move six patients. A three-quarter-inch continuous gap at the top of that wall means the assembly does not do that, and the ceiling tile hides it perfectly.

That is the connection between quality management and safety management that Chapter 24 develops in full: a quality failure in a life-safety system is a safety failure with a delay fuse on it. It does not hurt anybody the day you build it. It hurts somebody on a night, years later, when the building is asked to do the one thing that wall was for.

What Kestrel changed

  1. A standing "boundary review" in buyout. Scope sheets for adjacent trades are compared side by side, exclusion list against exclusion list, by two people, with a written list of every item that appears in neither. On the next project the boundary review produced 23 items; 6 were real gaps.
  2. A close-in release hold point for every concealment event. Not just exterior walls. Before ceiling grid, before hard lids, before shaft walls close, before floor topping. One checklist, one signature, one photograph set per area.
  3. Third-party firestop inspection engaged on every rated building, whether or not the specification requires it, at a cost in the range of one to two hundredths of a percent of contract value.
  4. Access panels detailed at every concealed inspectable condition. If a rated joint ends up above a hard ceiling, there is an access panel, or there is a photographic record accepted by the AHJ before the lid goes up. Preferably both.

Discussion Questions

  1. Bulwark and Summit were both, on the plain language of their scope sheets, correct. If both subcontractors are right, what exactly did Kestrel do wrong, and at what specific moment? Name the meeting and the document.

  2. Pri Sethi accepted $31,030 against the GMP construction contingency but refused the remaining $199,500. Reconstruct her reasoning. Was she right? Draft the two-paragraph argument Ray might have made for a larger share, and then draft her rebuttal.

  3. This project's liquidated damages attached to substantial completion, which had already been achieved, so no LDs ran. Rewrite the outcome for a contract in which substantial completion requires an unrestricted certificate of occupancy. What is the total exposure, and how does that change the decisions Kestrel makes on September 21?

  4. The chapter argues that inspection cannot produce quality. Yet in this case an inspection — the fire marshal's — is what saved the building. Is that a contradiction? Answer carefully, and in your answer distinguish between what the inspection accomplished and what it cost.

  5. Of the four system changes Kestrel made, one costs real money on every future project. Which one, roughly how much on a $47.5M job, and would you spend it?


Your Turn

You are the Kestrel project engineer in month five, sitting at the buyout table with the Bulwark scope sheet on your left and the Summit scope sheet on your right.

  1. Write the boundary review for just these two trades. List every item that could plausibly fall between "rated partition construction" and "firestopping," and mark each one Bulwark / Summit / neither / unclear. Aim for at least eight items. (Hints to get you started: head-of-wall joints, wall-to-wall joints at partition intersections, perimeter slab-edge fire containment, penetrations made by trades who arrive after Bulwark demobilizes, sleeves and their annular space, top-of-wall deflection track and its listing, temporary penetrations for construction, and the labeling of rated walls above ceilings.)

  2. For every item you marked neither or unclear, write the one sentence you would add to one of the two scope sheets to close it. One sentence each. This is the entire skill.

  3. Then estimate: what is the total dollar value of the items you just closed, priced as base scope in month five? Compare it to $230,530 and write one sentence about what buyout is actually for.
