Chapter 38 — Further Reading

Ten pointers, all real bodies, standards families, or primary documents. Where I am not certain of an exact title, edition, section number, or table, I describe the source rather than invent a citation — and you should hold every author to that standard, including me.

This chapter deliberately quoted no specification section, no pay-factor table, no permit number, and no statute. Everything in it was described by function, because the specifics vary by agency, by state, and by funding source, and they change. The list below is how you replace those descriptions with the real thing for the job you are actually on.


1. The standard specifications that govern your contract — and how to get the right ones

What it is: Every state department of transportation, and most large municipal public works and utility agencies, publish a book of standard specifications governing materials, workmanship, measurement, and payment for every item of work they buy, together with a set of standard drawings (standard plans) of pre-approved details. Your contract adds special provisions that add to, delete from, or amend the standard specifications for your job only.

How to obtain them: they are public and generally free. State DOT standard specifications are typically published on the agency's own site, along with the standard drawings and a list of supplemental or interim revisions. Municipal agencies often adopt a regional or statewide standard by reference.

The trap, and read this twice: your contract names an edition, and it is frequently not the current one. Downloading today's book when your contract incorporates a prior edition plus a set of supplemental specifications is how people get measurement clauses wrong in a way nobody catches until final quantities. Find the incorporation language in your contract, get that edition, and get every supplemental revision listed with it.

Why read it: because you are presumed to know all of it. "I didn't know your spec required a pre-blast survey" is not an argument, it is an admission. Start with the measurement and payment paragraph of every item you priced above a dollar threshold, then the differing site conditions clause, the quantity variation clause, the force account provision, and the contract-time provision.

Who it's for: everyone on a public job, in the first week. If you read one thing on this list, read this one.


2. FHWA — the Federal Highway Administration

What it is: the federal agency administering the federal-aid highway program. It publishes guidance and program requirements that reach into a very large share of state and local highway work through federal-aid funding, and it maintains substantial resource libraries on construction program administration, work-zone safety and mobility, accelerated bridge construction, and the use of alternative contracting methods.

Why read it: two reasons. First, federal-aid rules ride along with the money — Buy America requirements on certain materials, wage and civil rights compliance, DBE program obligations, and specific reporting duties — and if your project has federal participation, those requirements apply regardless of what your state normally does. Second, FHWA's technical material on work-zone safety and on accelerated construction methods is the best free explanation available of why agencies choose the expensive method: the user cost of a six-month detour for 42,000 vehicles a day is a number FHWA has taught agencies to compute.

Who it's for: anyone bidding highway work, and anyone who cannot explain why an owner picked a method that costs 25 percent more to build.


3. AASHTO — the American Association of State Highway and Transportation Officials

What it is: the body through which the state transportation departments develop common design guidance, material specifications, and test methods. Most state standard specifications are built on an AASHTO foundation, which is why a specification from an unfamiliar state is recognizable rather than alien.

Why read it: it explains the family resemblance. When you understand that your state's asphalt acceptance provisions, its bridge design references, and its material test methods trace back to common AASHTO documents, moving to a new state stops being a matter of learning a new language and becomes a matter of finding the dozen places your new agency departed from the common pattern. Those departures are exactly where your bid gets it wrong.

Who it's for: contractors expanding into a new state — the M5 exercise in this chapter's problem set is precisely this question.


4. The geotechnical baseline report — the concept, and the guidance behind it

What it is: a contract document that does not merely report what borings found but states the subsurface conditions the parties agree to treat as the contractual baseline for pricing. Conditions worse than the baseline are a differing site condition and are compensable; conditions better belong to the contractor as an opportunity, or are shared. The practice came out of tunneling and heavy underground construction, where the ground risk was too large to leave unallocated, and it has been spreading into other heavy civil work. ASCE has published guidance on preparing geotechnical baseline reports, developed out of that underground tradition.

Why read it: because §38.4.4 makes an argument you should not take on faith — that a GBR does not eliminate ground risk, it converts an unpriceable unknown into an allocated, measurable one, and that risk which cannot be priced gets priced anyway, badly, by everyone. The guidance literature is where you see what a baseline statement actually looks like, how specific it has to be to work, what it costs an owner in up-front investigation, and the honest discussion of where the mechanism fails.

Who it's for: owners and owner's representatives deciding how much geotechnical investigation to fund; contractors who want to argue for a GBR on the next job; and anyone who has ever carried a private, unpriced contingency for ground they could not see.


5. ASCE — the American Society of Civil Engineers, and the subsurface utility data standard

What it is: the professional body for civil engineering, publisher of consensus standards, technical guidance, and the periodic assessment of national infrastructure condition and investment need that shapes how agencies talk about their own capital programs.

The one to ask for by name is the standard that classifies subsurface utility information by quality level — the consensus document behind everything in Case Study 2 about subsurface utility engineering. It defines the tiers, from records research, through surface geophysics that designates a facility's horizontal position, up to the highest level, which requires test holes that physically expose the facility and survey its actual horizontal position and elevation. Ask for it by that function rather than by a number you half-remember, and confirm the current edition before you cite it in a scope of work.

Why read it: because "we did a utility investigation" means five different things depending on the level, and the difference between them is the difference between a better guess and a number you can build to. If you are writing a scope for SUE work — as an owner, a designer, or a contractor buying it — the quality levels are the vocabulary you write it in.

Who it's for: anyone doing urban utility work; anyone who has been surprised by a facility that was not where the drawing said.


6. ARTBA and the heavy-civil trade associations

What it is: the American Road & Transportation Builders Association is the principal trade association of the transportation construction industry; it maintains substantial work-zone safety resources and training. Alongside it, several associations serve the parts of the sector this chapter surveyed: AGC of America, which has a long-standing highway and transportation division and publishes heavy-civil contract documents and guidance; the National Utility Contractors Association for underground utility work; the Deep Foundations Institute for drilled shafts, piles and related foundation work; the National Asphalt Pavement Association and the American Concrete Pavement Association on the paving side; and the Precast/Prestressed Concrete Institute for girders and precast elements.

Why read it: these are where the production knowledge lives — paving train logistics, drilled shaft methods, trenchless technique selection, and the operational safety material that is written by people who run this work rather than by people who regulate it. They are also where you find the current state of practice on questions this chapter could only introduce, such as when trenchless beats open-cut once traffic control and business disruption are priced.

Who it's for: superintendents and project engineers who want depth in one operation; estimators building production rates from something better than memory.


7. OSHA's construction standards — by subpart topic

What it is: the federal construction safety standards, 29 CFR Part 1926, organized into subparts by topic. The one this chapter leans on hardest is Subpart P, Excavations, which governs protective systems, the competent person's daily inspections and inspections after every rainstorm, spoil pile setback, access and egress, and atmospheric hazards in trenches.

The other subparts that matter daily on heavy civil work are best found by topic rather than by a letter you might misremember: fall protection; cranes and derricks in construction; blasting and the use of explosives; concrete and masonry construction, which covers formwork and shoring; confined spaces in construction; and the standards governing respirable crystalline silica, hearing conservation, and personal protective equipment. State-plan states may have their own standards that are at least as stringent as the federal ones and sometimes more so — if you work in a state-plan state, that is the version that applies to you.

Why read it: because the excavation standard in particular is short, readable, and directly operational, and because a trench collapse gives no warning. Read Subpart P once, all the way through, and then read Chapter 24 and Appendix F again with it in mind.

Who it's for: every person who will ever stand at the edge of an open trench, which on this kind of work is everybody.


8. Published decisions on differing site conditions and quantity claims

What it is: the boards of contract appeals that decide federal construction disputes publish their decisions freely, and many state agencies, boards, and courts publish theirs. They are long, factual, and written for a reader who was not there.

Why read it: this is the best free education in existence on why differing-site-conditions claims win and lose. Find two or three decisions turning on a Type I claim and read them start to finish. You will see precisely which records were persuasive and which were not; how a tribunal treats a general disclaimer against an affirmative indication in a boring log; how much weight a contemporaneous field record carries against a reconstructed one; what "opportunity to inspect" actually means when the contractor kept digging; and how a contractor who conceded genuine concurrency is treated differently from one who claimed everything. It will change how you keep records on Monday, which is the entire point of Case Study 1.

Who it's for: project engineers, project controls staff, and anyone who will ever write a notice letter.


9. The federal changes and differing site conditions framework

What it is: the Federal Acquisition Regulation contains the standard changes, differing site conditions, and suspension of work clauses used on federal construction, and the Contract Disputes Act establishes the claim and appeal process. On federal work the Miller Act governs payment and performance bonds, and the Davis-Bacon Act and related statutes govern prevailing wages.

Why read it: the federal differing-site-conditions clause is the origin of the two-type structure that §38.4.1 describes, and reading the actual clause — Type I against what the contract documents indicated, Type II as unknown and unusual — will sharpen how you read the equivalent provision in a state DOT specification or a municipal contract, even if you never bid a federal job. Federal construction is also the most heavily documented claims regime in the country, which is why the case law in item 8 is so rich.

Who it's for: anyone considering federal work, and anyone who wants a rigorous model of how these clauses can be drafted.


10. Your state's prevailing wage determination, DBE program, and utility relocation rules

What it is: three separate bodies of jurisdiction-specific requirement that shape how you staff and administer a public heavy civil job. Prevailing wage: the federal determination applicable to federally assisted work, and your state's own prevailing wage statute for state and local work — some states have none, some have thresholds, some use entirely different classification systems, and the law changes. DBE: the program goals and good-faith-effort documentation applicable to federally assisted transportation contracts, including the rules on substituting a committed firm and the commercially-useful-function requirement. Utility relocation: many states have statutes or agency rules governing who pays for and who schedules utility relocations in public rights-of-way — which, as Case Study 2 shows, decides whether a utility delay costs you time or costs you money.

Why read it: because misclassification findings carry back wages, penalties, and potential debarment, and debarment ends a public-work contractor's business. Because a DBE arrangement structured to create the appearance of participation is fraud, not a gray area. And because the utility clause is the paragraph that decided $42,350 on Fairmount Avenue and that nobody read on bid day.

Who it's for: anyone bidding public work in an unfamiliar jurisdiction. Do this research once per state and keep the file.


What is deliberately not here, and the assignment that is worth more

There is a large market in unit-cost databases and estimating references, and they are genuinely useful for a first pass. I am not sending you there for this chapter, because the whole argument of §38.5 is that a heavy civil unit price is not something you look up. It is the output of a production calculation, and the two contractors in Exercise B3 who bid $38.50 and $22.00 for the same excavation item are not disagreeing about a published number — they are disagreeing about a cycle time, a haul distance, a fleet, and how much fixed cost each one has to bury.

So here is the assignment, worth more than any of the ten items above.

Get the standard specifications for the agency nearest you. Find the measurement and payment clause for structural excavation and for one pipe item. Write down, for each: the unit, the method of measurement, and every activity the clause declares incidental. Then take the unit price you would have guessed for those items and rebuild it from a cycle — machine, bucket, fill factor, cycle time, efficiency, swell, fleet match, hourly spread cost, and the neat-line factor — and see how far apart your guess and your calculation are.

Then find that agency's differing site conditions clause and its quantity variation clause and answer four questions in writing: how many days do you have to give notice; does the clause require notice before the condition is disturbed, in words; what is the variation threshold and how is a "major item" defined; and does the variation clause apply to increases, decreases, or both?

Two hours. It will tell you more about whether you can make money on that agency's work than any book will, including this one.
